CITY OF SAN LEANDRO <br /> SUBDIVISION IMPROVEMENT AGREEMENT <br /> (PRIVATE IMPROVEMENTS) <br /> THIS AGREEMENT, executed in triplicate, for purposes of identification dated Apri 1 17 , 2000 , <br /> is made and entered into by and between the City of San Leandro, a municipal corporation of the State of <br /> California, hereinafter referred to as "City," and San Leandro Investors, a Limited Liability Company, <br /> whereby the general contractor, SCS Development Company, a California corporation DBA Citation <br /> Homes Central (hereinafter designated as "principal and Subdivider "), <br /> RECI'T'ALS <br /> A. Subdivider has presented to City a certain final map or parcel map of a proposed subdivision of <br /> land located within the corporate limits of the City of San Leandro. <br /> B. The proposed subdivision of land is commonly known and described as Improvement Plans <br /> Tract 7075 and 7174 — Cherry Wood (Phase 1 & 2), San Leandro, Alameda County, California, APN <br /> 075 - 0155 - 001 -02, 002 -11, 002 -12, 002 -08, 002 -02, 004 and 075- 0207 -001, 003 -01, 004 -00, 005 -01, 006- <br /> 01, 006 -04, 007 -01, 007 -02, 007 -03, 008 -02, and bears the Subdivision Map Tract No. 7078. Said <br /> subdivision is hereinafter referred to as "the subdivision." <br /> C. The map of the subdivision was filed with the City Engineer for presentation to tit City Council <br /> of City for its approval which map is referred to and incorporated herein. <br /> D. Subdivider has requested approval of the map prior to the construction and completion of <br /> improvements including, but not limited to, streets, highways or public ways, public utility facilities and <br /> other facilities which are part of or appurtenant to the subdivision that are required by the Subdivision Map <br /> Act, the Subdivision Regulations of City, the Vesting Tentative Map (and approvals given in connection <br /> therewith) and final grading plan, if any. heretofore approved by City.
