CITY OF SAN LEANDRO SUBDIVISION IMPROVEMENT AGREEMENT (PRIVATE IMPROVEMENTS) THIS AGREEMENT, executed in triplicate, for purposes of identification dated Apri 1 17 , 2000 , is made and entered into by and between the City of San Leandro, a municipal corporation of the State of California, hereinafter referred to as "City," and San Leandro Investors, a Limited Liability Company, whereby the general contractor, SCS Development Company, a California corporation DBA Citation Homes Central (hereinafter designated as "principal and Subdivider "), RECI'T'ALS A. Subdivider has presented to City a certain final map or parcel map of a proposed subdivision of land located within the corporate limits of the City of San Leandro. B. The proposed subdivision of land is commonly known and described as Improvement Plans Tract 7075 and 7174 — Cherry Wood (Phase 1 & 2), San Leandro, Alameda County, California, APN 075 - 0155 - 001 -02, 002 -11, 002 -12, 002 -08, 002 -02, 004 and 075- 0207 -001, 003 -01, 004 -00, 005 -01, 006- 01, 006 -04, 007 -01, 007 -02, 007 -03, 008 -02, and bears the Subdivision Map Tract No. 7078. Said subdivision is hereinafter referred to as "the subdivision." C. The map of the subdivision was filed with the City Engineer for presentation to tit City Council of City for its approval which map is referred to and incorporated herein. D. Subdivider has requested approval of the map prior to the construction and completion of improvements including, but not limited to, streets, highways or public ways, public utility facilities and other facilities which are part of or appurtenant to the subdivision that are required by the Subdivision Map Act, the Subdivision Regulations of City, the Vesting Tentative Map (and approvals given in connection therewith) and final grading plan, if any. heretofore approved by City. Said improvements are hereinafter referred to as "the required improvements."
