WHEREAS, the City Council adopted Ordinance No. 2000- 07. on <br /> June 5, 2000 establishing a park facilities development impact fee ( "Park Impact <br /> Fee ") applicable to development within the City and providing for adoption of a Resolution to set <br /> forth the amount of the fee, describe the benefit and impact area on which the fee is imposed, <br /> describe the facilities to be financed, describe the estimated cost of these facilities, and describe the <br /> reasonable relationship between the use of the fee, the need for the fee and the types of development <br /> projects on which the fee is imposed and setting forth time for payment; and <br /> WHEREAS, Hausrath Economics Group has prepared a report dated January, 2000 entitled <br /> "City of San Leandro Park Impact Fee Study" which is attached as Exhibit A (hereafter the <br /> "Report "); and <br /> WHEREAS, the Report demonstrates the appropriateness of establishing a Park Impact Fee <br /> based on current estimates of the need for and cost of City park facilities needed to accommodate <br /> new development, subject in part to the Quimby Act, including (1) an inventory of existing park <br /> facilities establishing the City's park facility standard, (2) a statement of the park facility standard <br /> per 1,000 residents, (3) an estimate of the increase in the City's service population between the year <br /> 2000 and the year 2020, and (4) the cost of maintaining the City's utility standard for the estimated <br /> increase in the City's service population by 2020; and <br /> WHEREAS, in accordance with Govemment Code Section 66016, at least 14 days prior to <br /> the public hearing at which this Resolution was adopted, notice of the time and place of the hearing <br /> was mailed to eligible interested parties who filed written requests with the City for mailed notice <br /> of meetings on new or increased fees or service charges; and <br /> WHEREAS, in accordance with Government Code Section 66016, the Report was available <br /> for public review and comment for ten days prior to the public hearing at which this Resolution was <br /> adopted; and <br /> WHEREAS, 10 days advance notice of the public hearing at which this Resolution was <br /> adopted was given by publication in accordance with Section 6062a of the Government Code; and <br /> FINDINGS <br /> WHEREAS, the City Council finds as follows: <br /> A. The purpose of the Park Impact Fee set forth in this Resolution is to finance park <br /> facilities to reduce the impacts caused by future development in the City. <br /> B. The Park Impact Fee collected pursuant to this Resolution shall be used to finance <br /> park facilities to assure that future development does not result in a reduction in current levels of <br /> park facilities service, as described in the Report. <br /> C. After considering the Report, the testimony received at this noticed public hearing, <br /> the agenda statements, the General Plan, and all correspondence received (together, "Record "), the <br />
