IN TFIE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2000 - 67 (1120/1313 -8/ <br /> 2288 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ADOP'T'ING A NEGATIVE DECLARA'T'ION FOR AMENDMENT NO. 9'1'O THE <br /> PLAZA I REDEVELOPMENT PLAN AND AMENDMENT NO. 15 TO THE PLAZA 2 <br /> REDEVELOPMENT PLAN <br /> WHEREAS, the Redevelopment Agency of the City of San Leandro (the `Agency ") has <br /> prepared a proposed Amendment No. 9 to the Plaza I Redevelopment and a proposed <br /> Amendment No. 15 to the Plaza 2 Redevelopment Plan and has recommended the amendments <br /> for adoption by the City Council of the City of San Leandro; and <br /> WHEREAS, pursuant to the California Environmental Quality Act ( "CEQA ") (Public <br /> Resources Code Section 21000 et seq.), the City Council is the "Lead Agency" as defined by <br /> CEQA (Public Resources Code § 21067); and <br /> WHER.EAS, pursuant to the CEQA, the Agency is a "Responsible Agency" as defined by <br /> CEQA (Public Resources Code § 21067); and <br /> WHEREAS, the City prepared a Negative Declaration for the adoption of the <br /> amendments; and <br /> WHEREAS, the City circulated the Negative Declaration for public comment from April <br /> 13, 2000 through May 12, 2000; and <br /> WHEREAS, one public comment on the negative declaration was received from the <br /> Department of Toxic Substances Control, such comment provided the Agency with additional <br /> infomtation regarding hazardous materials in the Plaza 2 Project Area, the Agency was already <br /> aware of the hazardous materials specified in the comment, and issues regarding hazardous <br /> materials will not be affected by the proposed merger. <br /> NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> DOES RESOLVE AS FOLLOWS: <br /> Section 1. The City has reviewed and considered the Negative Declaration, finds that it <br /> reflects the independent judgment of the City as lead agency, hereby finds that there is no <br /> substantial evidence that the project will have a significant effect on the environment. <br />
