IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2010 -112 RESOLUTION CANCELING AWARD OF CONTRACT TO ANDES CONSTRUCTION, INC.. AND AWARDING CONTRACT TO THE SECOND LOWEST BIDDER, D'ARCY & HARTY CONSTRUCTION, INC. FOR THE 2009 SANITARY SEWER PIPELINE REPLACEMENT PROJECT, PROJECT NO. 09- 593 -52 -211 Recitals The City of San Leandro did, on July 13, 2010, publicly open, examine and declare all sealed proposals or bids for doing the work described in Resolution No. 2010 -032 of the Council of said City adopted on March 15, 2010, which resolution is hereby expressly referred to for a description of said work and for all particulars relative to the proceedings under said resolution. Said proposals were submitted to the Engineering and Transportation Director who has recommended that the proposal hereinafter mentioned is the second lowest responsive bid for doing said work. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That said City Council hereby rescinds previous award of the contract to Andes Construction. Inc., the lowest bidder; and That said City Council hereby rejects all of said proposals or bids except that herein mentioned, and hereby waives any irregularities in the proposal or bid of the second lowest responsible bidder, and hereby awards the contract for doing said work to the second lowest responsible bidder therefore, to wit: D'Arcy & Harty Construction, Inc., at the prices named in its bid on file in the Office of the City Clerk.
