APPENDIX "A" <br /> The monthly pay rates for 2011 and 2012 shall be as applicable below: <br /> Classification Monthly Pay Range <br /> Step 1 Step 2 Step 3 Step 4 Step 5 <br /> Police Sergeant $7655 $8038 $8440 $8862 $9305 <br /> Police Officer $6379 $6698 $7033 $7385 $7754 <br /> Police Recruit Trainee, pt — hourly rate $30.00 <br /> The City shall contribute to the Public Employees' Retirement System (PERS) each pay period a <br /> portion of the employee contribution rate as established by law equal to nine percent (9 %) for <br /> sworn employees represented by the Association of the employee's "compensation" as that term <br /> is administered by the Board of Administration of PERS as of the above date. <br /> Contributions made pursuant to this section shall be reported to PERS as "employee <br /> contributions being made by the contracting agency. They shall be reported as compensation for <br /> retirement purposes. The City will not treat these contributions as compensation subject to <br /> income tax withholding unless the Internal Revenue Service or Franchise Tax Board determines <br /> that such contributions are taxable income subject to withholding. <br /> Each employee is solely and personally responsible for any federal, state or local tax liability of <br /> the employee that may arise out of the implementation of this section or any penalty that may be <br /> imposed therefore. <br /> Except as set forth in the following paragraph the aforesaid contribution shall be considered <br /> solely for the purpose set forth herein and shall not be considered for any other purpose, <br /> including but not limited to being considered as part of any employee's salary for the purpose of <br /> computing straight time earnings, compensation for paid leaves, compensation for overtime <br /> • <br /> worked, compensation benefits.
