• 2 JH:DJO:brf 5/8/00 < RESOLUTION NO. 2000 - 85 (2887 ) A RESOLUTION APPOINTING SPECIAL TAX CONSULTANT, ATTORNEYS, FINANCIAL ADVISOR AND UNDERWRITER City of San Leandro Community Facilities District No. 1. (Cherrywood) RESOLVED, by the City of San Leandro, California (the "City "), as follows: WHEREAS, the City intends to undertake proceedings pursuant to the Mello -Roos Community Facilities Act of 1982, as amended, for the financing of certain facilities and services; and WHEREAS, the public interest and convenience will be served by appointing and employing a special tax consultant, attorneys, financial advisor and underwriter for the preparation and conduct of the proceedings, and the issuance of bonds, all of such consultants to perform their respective services pursuant to previously approved agreements with the City; and WHEREAS, it is also necessary to appoint a firm to perform appraisal services in connection with real property in the proposed financing district. NOW, THEREFORE, it is hereby ORDERED and DETERMINED, as follows: 1. That McGill Martin Self, Inc., is appointed as Special Tax Consultant and employed to do and perform certain work necessary in and for the proceedings, including preparation of the community facilities report and the rate and method of apportionment of the special tax pursuant to a previously approved contract for such services. 2. The law fine of Jones Hall, A Professional Law Corporation, San Francisco, California, is appointed and employed to serve as•Bond Counsel and as Disclosure Counsel to the City in connection with the proceedings and the issuance of bonds pursuant to a Legal Services Agreement for such services on file with the City Clerk, execution of which by the Finance Director is hereby approved. 3. That E. Wagner & Associates, Inc., is appointed as Financial Advisor to the City in connection with the establishment of the community facilities district and the issuance of bonds pursuant to a contract for such services on file with the City Clerk, execution of which by the Finance Director is hereby approved. 4. That Prager, McCarthy & Sealy is appointed as Underwriter in connection with the issuance of bonds, said firm's compensation to be as set forth in a bond purchase contract that will be approved by separate resolution of the Council at the time that the bonds are au thorized.
