•- IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2000 - 112 ((2888Y1 - 330 <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> APPROVING THE REUSE REPORT REQUIRED BY HEALTH & SAFETY <br /> CODE * 33433 AND THE AMENDED AND RESTATED DISPOSITION AND <br /> DEVELOPMENT AGREEMENT BETWEEN THE CREEKSIDE <br /> ASSOCIATES, LLC AND THE SAN LEANDRO REDEVELOPMENT <br /> AGENCY FOR THE SALE OF PROPERTY TO BE DEVELOPED AS A <br /> BUSINESS PARK, LOCATED AT 960 SAN LEANDRO BOULEVARD APN <br /> 75- 36 -52, PLAZA REDEVELOPMENT PROJECT AREA AND <br /> AUTHORIZING AND APPROVING THE EXECUTION OF A LICENSE <br /> AGREEMENT IN CONNECTION THEREWITH <br /> RECITALS <br /> WHEREAS, the Redevelopment Agency of the City of San Leandro ( "Agency ") entered <br /> into a Disposition and Development Agreement (the `February Agreement ") with Creekside <br /> Associates, LLC ( "Creekside "), pursuant to Agency authorization given following the conduct of <br /> ajoint public hearing of the Agency and the City Council on February 22, 2000 (the "February <br /> Approval Date "); <br /> WHEREAS, subsequent to the February Approval Date, Creekside has proposed to the <br /> Agency that the February Agreement be replaced or cancelled and that the parties instead enter <br /> into an agreement entitled "Amended and Restated Disposition and Development Agreement" <br /> submitted herewith (the "Agreement "). In connection with that request, Creekside has submitted <br /> a development concept plan (the "Development Concept Plan") for the development of the <br /> "Property" (which is that certain property described in Exhibit "A" to the Agreement), including <br /> certain amenities to adjacent City property along the creek, which Development Concept Plan is <br /> attached as Exhibit "B" to the Agreement. The Development Concept Plan provides for a <br /> different and more intense development of the Property than that which had been provided for <br /> under the February Agreement, and which shall specifically include a parking structure as more <br /> particularly described in the Agreement; <br /> WHEREAS, the Agreement provides for the disposition by the Agency to Creekside the <br /> property at 960 San Leandro Boulevard (the "Property ") for a purchase price of Two Million <br /> Seven Hundred Sixty Three Thousand Four Hundred Twenty One Dollars ($2,763,421) (the <br /> "Purchase Price ") and additional consideration under the terms of the Agreement; <br /> WHEREAS, Agency has caused to be prepared a report required by Health and Safety <br /> Code § 33433 ( "Reuse Report ") which contains a summary of the Agreement to be entered into <br /> between the Agency and Creekside and a summary of the cost of Agreement to the Agency, and <br /> the Agency has made the Reuse Report available for public inspection pursuant to Health and <br /> Safety Code § 33433; <br /> DOCS00750474v 1\2425x.0001 <br />
