• • maintenance responsibilities, all in accordance with specifications and as more particularly described in the Agreement WHEREAS, the Agency has reviewed and hereby approves a report prepared by Keyser Marston, Incorporated, which report evaluates the fair value of the Property given the restrictions, conditions and covenants of the Agreement; WHEREAS, all environmental review for this Agreement has been carried out and obtained; and WHEREAS, the Planning Commission of the City of San Leandro has made a finding at its November 10, 1999, meeting that the disposition of property provided by the Agreement is consistent with the City's General Plan. NOW, THEREFORE, the Redevelopment Agency of the City of San Leandro finds, determines, and approves as follows: Section 1. The Agency finds and determines that all required environmental review for this Agreement has been carried out and obtained. Section 2. The Agency finds and declares that the consideration to be paid by Creekside for the Property under the Agreement is not less than fair reuse value given the restrictions, conditions and covenants the Property is subject to pursuant to the Agreement. Section 3. The Agency finds and declares that the consideration, construction and operation provided in the Agreement will implement and carry out the provisions of the Plaza Redevelopment Project Plan ( "Plan ") and Implementation Plan for the Plaza Redevelopment Project ( "Project "). Section 4. The Agency further finds and declares that the Agreement will assist in the elimination of blight in the Project Area by eliminating and preventing the spread of conditions of blight including underutilized and vacant land, and will additionally encourage further private investment in the Davis Street and San Leandro Boulevard corridors, create a high- quality office complex at a major entryway to the community (with plaza, related amenities, a parking structure, and improved and maintained creekside open space), and broaden the community's economic base, all in a manner compatible and consistent with the existing Implementation Plan and Redevelopment Plan. Section 5. The Agency further finds and declares that the Agreement will effectuate economic development programs, blight elimination and land development which is consistent with those set forth in the Project's Implementation Plan. Section 6. The Redevelopment Agency of the City of San Leandro hereby approves the Amended and Restated Disposition and Development Agreement and authorizes and directs the Executive Director to execute an Amended and Restated Disposition and Development Agreement in substantially the form presented to the Agency and execute any and all other documents necessary to implement the terms and conditions thereof. 2 oocs00750475v 1 u425 $.0001
