• • <br /> maintenance responsibilities, all in accordance with specifications and as more particularly <br /> described in the Agreement <br /> WHEREAS, the Agency has reviewed and hereby approves a report prepared by Keyser <br /> Marston, Incorporated, which report evaluates the fair value of the Property given the <br /> restrictions, conditions and covenants of the Agreement; <br /> WHEREAS, all environmental review for this Agreement has been carried out and <br /> obtained; and <br /> WHEREAS, the Planning Commission of the City of San Leandro has made a finding at <br /> its <br /> November 10, 1999, meeting that the disposition of property provided by the Agreement is <br /> consistent with the City's General Plan. <br /> NOW, THEREFORE, the Redevelopment Agency of the City of San Leandro finds, <br /> determines, and approves as follows: <br /> Section 1. The Agency finds and determines that all required environmental review <br /> for this Agreement has been carried out and obtained. <br /> Section 2. The Agency finds and declares that the consideration to be paid by <br /> Creekside for the Property under the Agreement is not less than fair reuse value given the <br /> restrictions, conditions and covenants the Property is subject to pursuant to the Agreement. <br /> Section 3. The Agency finds and declares that the consideration, construction and <br /> operation provided in the Agreement will implement and carry out the provisions of the Plaza <br /> Redevelopment Project Plan ( "Plan ") and Implementation Plan for the Plaza Redevelopment <br /> Project ( "Project "). <br /> Section 4. The Agency further finds and declares that the Agreement will assist in the <br /> elimination of blight in the Project Area by eliminating and preventing the spread of conditions <br /> of blight including underutilized and vacant land, and will additionally encourage further private <br /> investment in the Davis Street and San Leandro Boulevard corridors, create a high- quality office <br /> complex at a major entryway to the community (with plaza, related amenities, a parking <br /> structure, and improved and maintained creekside open space), and broaden the community's <br /> economic base, all in a manner compatible and consistent with the existing Implementation Plan <br /> and Redevelopment Plan. <br /> Section 5. The Agency further finds and declares that the Agreement will effectuate <br /> economic development programs, blight elimination and land development which is consistent <br /> with those set forth in the Project's Implementation Plan. <br /> Section 6. The Redevelopment Agency of the City of San Leandro hereby approves <br /> the Amended and Restated Disposition and Development Agreement and authorizes and directs <br /> the Executive Director to execute an Amended and Restated Disposition and Development <br /> Agreement in substantially the form presented to the Agency and execute any and all other <br /> documents necessary to implement the terms and conditions thereof. <br /> 2 <br /> oocs00750475v 1 u425 $.0001 <br />
