3. Collection of Assessment. This Agreement provides that the SLDA shall act <br /> as the collection agent for the City as provided in Section 2 -14 -140 of said ordinance. In <br /> acting in this capacity, the SLDA shall provide all services necessary to collect the <br /> assessments for the District as determined by the City Council including preparation of <br /> the assessment billing, distribution of the assessment billing and the collection and <br /> banking of assessments. The SLDA shall maintain detailed records of all assessments <br /> and delinquencies and submit payment to the City for deposit into the District Fund in <br /> 30 -day increments. Funds shall be transferred by means suitable to the City. <br /> 4. Payment of Funds. All funds collected pursuant to the provisions of said <br /> ordinance, as provided by this Agreement, shall be paid deposited into the District Fund <br /> maintained by the City Finance Department. Once the funds have been verified by the <br /> City they shall in turn be paid directly to SLDA by the City Finance Department, to be <br /> disbursed and/or expended pursuant to the provisions of the approved budget or amended <br /> budget. Payments will be advanced from the Fund in 30 -day increments as funds become <br /> available in said District Fund in the Finance Department. <br /> 5. Use Of Funds. All funds received by SLDA pursuant to this contract shall be <br /> used for one or more of the purposes specified in Section 2 -14 -125 of the aforesaid <br /> ordinance, as allocated in the aforementioned budget. Here it is understood that the <br /> purposes are the same as those also set forth in section 36000 of the Streets and <br /> Highways Code of the State of California. <br /> 6. Voluntary Contributions to SLDA. Any funds collected by voluntary <br /> contribution by SLDA from whatever source other than the voluntary District assessment, <br /> shall not be subject to an accounting to the City Council for the approval of the projects. <br /> SLDA shall in such budget set out the amount of funds proposed to be used, derived from <br /> any source, in order that the Council may appropriately determine the feasibility of the <br /> project and the ability of SLDA to finance same. <br /> 7. Record of Benefit Assessment. The City Finance Department shall maintain <br /> a record of all benefit assessments made pursuant to said ordinance and of all payments <br /> made pursuant to such assessments, and in the month of July each year, and quarterly <br /> thereafter, make available to SLDA a list of all assessments and delinquencies, providing <br /> that said Finance Department shall not disclose any confidential information submitted to <br /> that office by a license payer and in connections with the determination of his /her <br /> assessment. A record of the total assessment of an individual licensee, or the fact that <br /> said licensee has allowed the assessment payment to become delinquent, is not deemed to <br /> be confidential. <br /> 8. Books, Records, and Audit. SLDA shall keep a complete standard form of <br /> books showing all receipts and all disbursements made pursuant to the provisions of the <br /> agreement, and said books and records shall at all times be the subject of an audit by the <br /> Finance Department. <br /> 9. Indemnity'. It is clearly understood that all work done and performed by <br /> SLDA pursuant to this agreement and all events held or conducted pursuant hereto shall <br /> be solely the responsibility of SLDA. In this connection, SLDA agrees to indemnify and <br /> hold City harmless of and from all claims of any kind and character for injuries to person <br />
