IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2000- 114 (1049) <br /> RESOLUTION APPROVING TERMNATION OF THE MAINTENANCE, OPERATION <br /> AND RECIPROCAL EASEMENT AGREEMENT (MOREA) FOR 1371 EAST 14 STREET <br /> AND 1330 WASHINGTON AVENUE, DATED OCTOBER 31, 1984, <br /> AND AMENDED MAY 5, 1997 <br /> WHEREAS, in 1984, the City of San Leandro, Sizzler Restaurants International, Inc., and <br /> Eureka Federal Savings and Loan Association of San Francisco entered to a Maintenance, <br /> Operation and Reciprocal Easement Agreement for the real property located between East 14' <br /> Street, West Joaquin Avenue, Washington Avenue, and West Estudillo Avenue (the <br /> "Agreement "); and <br /> WHEREAS, the Agreement was amended once previously; and <br /> WHEREAS, the successors -in- interest to Sizzler and Eureka Federal Savings and Loan • <br /> Association and the City desire to terminate the Agreement; and <br /> WHEREAS, a Termination of the Agreement has been prepared and reviewed by the City <br /> Manager and City Council; and <br /> WHEREAS, the termination of the Agreement is exempt from the requirements of the <br /> California Environmental Quality Act because the termination will not cause a direct physical <br /> impact to the environment nor will it have a foreseeable indirect impact on the environment. <br /> NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> DOES RESOLVE AS FOLLOWS: <br /> Section 1. The City Council hereby authorizes the termination of the Maintenance, <br /> Operation and Reciprocal Easement Agreement. <br /> Section 2. The City Council hereby directs the City Manager to execute the Termination <br /> and any other documents necessary to terminate the Agreement. <br /> • <br /> 1 <br /> • <br />
