8. SECTION 504 - PROGRAM ACCESSIBILITY <br /> A. General Prohibition Against Discrimination <br /> • No qualified individual with a handicap shall, solely on the basis of handicap, be excluded <br /> from participation in, be denied the benefits of, or otherwise by subjected to discrimination by <br /> a contractor receiving Federal assistance as part of the CDBG program. <br /> 1. Specific Prohibitions Against Discrimination <br /> • <br /> A contractor who receives Federal assistance as part of the CDBG program, in <br /> providing any service, benefit, aid or housing may not, directly' or through <br /> contractual, licensing, or other arrangements, solely on the basis of handicap: (a) <br /> deny; (b) afford unequal treatment; (c) provide ineffective service, benefit, aid or <br /> housing; (d) provide different service, benefit, aid or housing; or (e) limit the <br /> enjoyment of any right, privilege, or advantage, to a qualified individual with <br /> handicaps the opportunity to participate in, or benefit from, the service, benefit, aid or <br /> housing; <br /> B. Provisions Regarding Communications With Individuals With Handicaps <br /> A contractor who receives Federal assistance as part of the CDBG program shall take <br /> appropriate steps to ensure effective communication with customers, clients, and other <br /> members of the public. Such steps, when appropriate, may include, but are not limited to: <br /> I. Furnishing appropriate auxiliary aids where necessary to afford an individual <br /> with handicaps an equal opportunity to participate in, and enjoy the benefits <br /> of, a program or activity receiving Federal financial assistance. A contractor <br /> is not required to provide individually prescribed devices, readers for personal <br /> use or study, or other devices of a personal nature. <br /> ?. Where a contractor communicates with customers, clients, and other members <br /> of the public by telephone, telecommunication devices for deaf persons <br /> (TDD's) or equally effective communication systems shall be used. <br /> 3. A contractor who receives Federal assistance as part of the CDBG program <br /> shall adopt and implement procedures to ensure that interested persons <br /> (including persons with impaired vision or hearing) can obtain information <br /> concerning the existence and location of accessible services, activities and <br /> facilities. <br /> 4. A contractor is not required to take any action that would result in a <br /> fundamental alteration in the nature of a program or activity or in undue <br /> financial or administrative burden. <br /> Exhibit E Page 7 of 7 <br />
