3. "Landlord." Brandenburg- Staedler Mission Bay Mobilehome Community, a <br /> California general partnership, or their designated representatives. <br /> 4. "Tenant." The person(s) who owns a mobilehome and holds a tenancy for a <br /> mobilehome space at Mission Bay Mobilehome Community under a fully <br /> executed rental agreement with the Community. <br /> 5. "Prospective Tenant." A potential "Tenant" as defined herein by virtue of his or <br /> her consideration of the purchase of a mobilehome at Mission Bay Mobilehome <br /> Community. <br /> 6. "Base Rent." Monthly rent for the mobilehome space, exclusive of any separately <br /> itemized utilities or other separately itemized charges, plus any base rent increases <br /> provided for in this Agreement. <br /> 7. "Rent Increase." Any additional rent demanded of, or paid by, a tenant for a <br /> mobilehome space. <br /> 8. "Space Rent." Money demanded or received in connection with the rental of a <br /> mobilehome space at Mission Bay Mobilehome Community, including utilities <br /> and any bonus, benefit or gratuity, demanded or received in connection with the <br /> use and occupancy of a mobilehome space, but exclusive of any amounts paid for <br /> the use of the mobilehome dwelling unit. <br /> 9. "Government Required Capital Improvements." An addition or improvement to <br /> the Park, an assessment against the Park, including a rehabilitation or replacement <br /> of an existing capital improvement in the Park required or mandated by any <br /> governmental body or agency, including but not limited to, the City of San <br /> Leandro, the County of Alameda, the State of Califomia, or the United States of <br /> America. <br /> 10. "Emergency or Disaster Related Occurrence or Event." A sudden event resulting <br /> from earthquake, fire, flood or other natural occurrence, or a major malfunction of <br /> any of the Park's underground or sewer systems, over which Landlord has no <br /> reasonable control, and which was not caused by Landlord's willful misconduct <br /> or gross negligence. This definition is intended to be illustrative and not <br /> exclusive. <br /> 11. "Park." Park is the Mission Bay Mobilehome Community located at 15333 <br /> Wicks Boulevard, San Leandro, Alameda County, Califomia. <br /> 12. "City." City of San Leandro. <br /> 2 <br />
