• 5. The City of Fremont will contribute $87,000 in CDBG funds for the acquisition and <br /> rehabilitation of the facility. <br /> 6. The City of San Leandro will contribute $54,675 in HOME funds for the acquisition and <br /> rehabilitation of the facility. <br /> 7. The PPJs will disburse their respective fiscal contributions pursuant to the approved project <br /> budget. <br /> • <br /> 8. The County of Alameda will act as lead agency in FESCO's rehabilitation of the project and <br /> will monitor during and after, the rehabilitation of the project. As such, it will, in compliance <br /> with appropriate Federal, State, and Local regulations, prepare all documents and undertake <br /> monitoring responsibilities required fix completion of the project, including regulations <br /> regarding Environmental Review and Relocation and Federal Labor standards. The City of <br /> Fremont and the City of San Leandro under a separate Deed of Trust(s) and Promissory <br /> Note(s), will provide partial acquisition financing. <br /> • <br /> 9. The County of Alameda, City of Fremont and the City of San Leandro shall have joint <br /> approval of work write up, budget, contractors, and progress payments. <br /> 10. The County of Alameda will keep all documents relating to the rehabilitation of the project <br /> readily accessible to the other PPJ for at least ten years from completion of the project. <br /> 11. The PPJs agree to the recording of one regulatory agreement against the property, that will <br /> be approved by the City of Fremont and the City of San Leandro, which will cover but not <br /> be limited to Occupancy Standards, Rent Restrictions, Reporting Requirements, Change of <br /> Use, and Property Disposition. The Regulatory Agreement shall be between the County of <br /> Alameda and FESCO. The PPJs authorize the County of Alameda to act in accordance with <br /> the regulatory agreement on their behalf. The County of Alameda will require that FESCO <br /> execute the Regulatory Agreement as a deed restriction recorded on the property. The <br /> County of Alameda shall monitor the performance of FESCO under the regulatory agreement . <br /> and shall be responsible for its enforcement in case of default. The County will notify the <br /> other Participating Public Jurisdictions of any failure by FESCO to act in accordance with the <br /> Regulatory Agreement. Amendments and alterations in the regulatory agreement may be <br /> made only by written consent of a designee from each PPJ. <br /> 12. The PPJs may at any time donate or sell any or all of their share in the acquisition or <br /> rehabilitation funds to another PPJ or FESCO. The value of these acquired shares will be <br /> valued at the original value of the contribution as determined by the PPPs percentage of <br /> participation in the project as defined in the regulatory agreement. <br /> 13. The County of Alameda agrees to hold harmless and indemnify the City of Fremont and the <br /> City of San Leandro, their officers, employees, and volunteers for any and all liability arising <br /> out of the County of Alameda's own negligent acts. <br /> • <br />
