IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2010 -117 <br /> RESOLUTION AMENDING TITLE 2, CHAPTER 5 OF THE SAN LEANDRO <br /> ADMINISTRATIVE CODE RELATED TO AMERICANS WITH DISABILITIES <br /> ACT /SECTION 504 OF THE REHABILITATION ACT OF 1973 RELATIVE TO <br /> REASONABLE ACCOMMODATION POLICY <br /> WHEREAS, the Federal Rehabilitation Act (Section 504) was enacted in 1973 and the <br /> Americans with Disabilities Act was enacted in 1990, both with the purpose of ensuring and <br /> protecting access for disabled individuals to government services, housing, and programs; and <br /> WHEREAS, the California Department of Housing and Community Development (HCD) <br /> has reviewed the City's adopted Housing Element and requested changes to this policy in order <br /> to certify the City's adopted Housing Element in order to comply with state and federal law. <br /> NOW THEREFORE, the City Council of the City of San Leandro does hereby <br /> RESOLVE as follows: <br /> Section I. Amendment of Code. Tile 2, Chapter 5 of the San Leandro <br /> Administrative Code is amended to read as follows: <br /> [New provisions proposed to be added are printed in italic type. Existing provisions proposed to <br /> be deleted are printed in gel t- ] <br /> Title 2 City Manager <br /> Chapter 5 Americans with Disabilities Act/ Section 504 of the Rehabilitation Act of 1973 <br /> ARTICLE lā€” COORDINATORS <br /> §2.5.100: SECTION 504 COORDINATOR AND ADA COORDINATOR. The City of <br /> San Leandro Section 504 Coordinator shall be the Housing Specialist 1 in the Community <br /> Development Department, and the Americans with Disabilities Act Coordinator will be the <br /> Community Relations Representative in the City Manager's Office, <br /> The 504 Coordinator and ADA Coordinator shall be responsible for coordinating the efforts of <br /> the City of San Leandro to comply with Section 504 of the Rehabilitation Act of 1973 and Title <br /> 11 of the Americans with Disabilities Act, respectively as they pertain to services, programs, <br /> events, activities, facilities and public meetings. The respective coordinator shall investigate <br /> complaints that the City or the City's subrecipients of Federal funding have violated statutes or <br /> regulations under the Acts, or other state or federal laws relating to persons with disabilities. <br /> Issues arising in the course of employment with or employment application to the City of San <br /> Leandro are covered by Administrative Procedure #1230 Reasonable Accommodation Process, <br /> and are not subject to the provisions of this Administrative Code Chapter. <br />
