Councilmember Starosciak pointed out that the Council has an existing policy, the "Guidelines Regarding Support for Ballot Measures." She recalled that there have been ballot measures, such as Measure B in 2006, on which the Council did not take a formal position, because they did not meet the criteria in the guidelines. Councilmember Starosciak asked if the policy is being set aside in order to consider a position on Prop 23 and Measure M. Mr. Hollister confirmed that the Council adopted the guidelines in 2004, which, due to an oversight by staff, were never incorporated into the Councilmembers Handbook. City Clerk Marian Handa stated that there has been no formal process for updating the Councilmembers Handbook, and so the guideline was never incorporated, and forgotten. Mr. Hollister indicated that, as a result, it appears that the Council has been inconsistent in its adherence to the guidelines, taking positions on some previous ballot measures, but not others. The Council discussed adherence to the existing guidelines; taking positions on the proposed ballot measures; referring the guidelines to the City Council Rules and Communications Committee for discussion; and the threat to AB 32 and SB 375, the existing climate protection legislation. A motion was made by Councilmember Prola, seconded by Councilmember Gregory, to adopt the resolution opposing Proposition 23. A friendly amendment was offered by Vice Mayor Reed, and accepted by Councilmember Prola, the maker of the motion, to refer review of the "Guidelines Regarding Council Support for Ballot Measures" to the City Council Rules and Communications Committee. • Minute Order No. 2010 -035, Motion to Refer the "Guidelines Regarding Council Support for Ballot Measures" to the City Council Rules and Communications Committee.
