DRAFT MINUTES Page 6 Cite of San Leandro Cite Council and San Leandro Redevelopment Agency Joint Meeting — November 15, 2010 • Ordinance No. 2010 -021 An Interim Urgency Ordinance of the City of San Leandro Malting Findings and Extending a Temporary Moratorium on the Establishment and Operation of Medical Marijuana Dispensaries, Marijuana Cultivation Facilities, or Other Land Uses that Relate to the Dispensing or Cultivation Facilities Pending the Review and Possible Amendment of Zoning Regulations Applicable to Medical Marijuana Dispensaries, Marijuana Cultivation Facilities, or Other Land Uses that Relate to Dispensing or Cultivating Medical Marijuana (extends the interim urgency ordinance to allow staff and the City Council time to insure the full array of issues and concerns regarding such uses are vetted amongst residents, relevant City boards and commissions, and the City Council). — Passed to print and adopted with amendment to extend the moratorium for 10 months and 15 days NI/S /C Prola and Gregory. Ayes: 5; Noes: 1 (Starosciak); Absent: 1 (Santos) B. Matter of Adoption of State - Mandated California Building Standards Codes and Related Amendments. This being the time and place for the Public Hearing on the above matter, City Manager Hollister introduced Chief Building Official William Schock to provide background on the matter. Mr. Schock reported that the state enacts a new set of building codes every 3 years. The ordinances would adopt or amend the various state building codes and provide carryover of the administrative provisions and amendments for structural provisions due to the City's proximity to the Hayward Fault. Councilmember Gregory asked if the new smoke alarms, such as those reviewed by the City of Albany, would ultimately be incorporated into the Fire Code. Mr. Hollister introduced Fire Marshal Bonnie Terra. Ms. Terra reported that the Fire Department is not making any recommendations at this time due to lack of solid data, and that the City of Albany did adopt a new ordinance relating to smoke detectors. She stressed the importance of having working smoke detectors. The Hearing was then opened to the public. There being no comments from the public, and without objection, the Public Hearing was closed. • Ordinance No. 2010 -013 an Ordinance Repealing Article 1 and Adding Article 1 to Chapter 5 of Title VII of the San Leandro Municipal Code, Amending the State - Mandated California Building Standards Code, and Adopting by Reference the International Building Code, as Amended, Relating to Building Code (adopts relevant codes by reference with minor structural amendments relating to updating seismic design criteria based on City's proximity to earthquake faults and corrections to the model code structural design standards).
