IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2010 - RESOLUTION AUTHORIZING NEGOTIATION OF A SOLE SOURCE CONTRACT WITH PUBLIC RESTROOM COMPANY FOR THE PURCHASE OF A PRE - FABRICATED RESTROOM FOR THE TOYON PARK RESTROOM REPLACEMENT PROJECT, PROJECT NO. 210 -62 -008 Recitals WHEREAS, use of a sole source purchase of a public restroom has been requested by the Engineering and Transportation Department; and WHEREAS, the City's General Plan Goal 21.01 encourages both renovation and Americans with Disabilities Act (ADA) upgrades of City parks: and WHEREAS, use of a sole source procurement allows the City to field test the use of a pre- fabricated public restroom structure for possible use on other future City projects; and WHEREAS. the City Manager has recommended waiver of competitive bidding for this sole source contract, as provided for in Section 1-6-315 of the San Leandro Municipal Code and in accordance with California Public Contract Code section 3400. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That the City Council finds that a sole source procurement is appropriate under California Public Contract Code section 3400(c)(1) in order that a field test may be made to determine the suitability of the product for future use; and That the City Manager is authorized to negotiate a sole source procurement with Public Restroom Company for a prefabricated restroom facility for installation at Toyon Park.
