• Acquisition of trash capture devices <br /> • Installation of trash capture devices <br /> • Maintenance and monitoring of the installed devices <br /> To participate in the project, the City of San Leandro must enter into an agreement with ABAG <br /> and comply with CWSRF requirements. The City would also be required to purchase the trash <br /> capture devices from a pre - approved ABAG vendor and agree to maintain the devices for their <br /> useful life, not to exceed 25 years. City staff anticipates it will purchase between 150 — 230 full <br /> trash capture devices with these grant funds. <br /> The initial allocation to the City of San Leandro is 599,593. The allocation amount may be <br /> increased to reflect unused funds from other municipalities that choose not to participate in the <br /> grant program, as those funds will be redistributed to participating agencies. <br /> Concurrently, the City of San Leandro as part of the, the Alameda Countywide Clean Water <br /> Program ( "ACCWP ") joined with three other municipal regional stormwater programs to <br /> determine whether we as a penmittee and other permittees to the 2009 Municipal Regional <br /> Stomiwater Permit (MRP) may be eligible to recover costs associated with implementing new <br /> requirements imposed by the MRP under the State's "unfunded mandates" law. Careful analysis <br /> has concluded that several MRP requirements have a high probability of success for those <br /> ACCWP permittees that wish to pursue them. Filing of a "test claim" at the Commission on State <br /> Mandates would assert that the City is entitled to be reimbursed by the state for costs relating to <br /> the various obligations imposed on the City by the Municipal Regional Stormwater Permit issued <br /> by the Regional Water Quality Control Board, including the installation and maintenance of trash <br /> capture devices. <br /> The current pursuit of the unfunded mandate claim against portions of the MRP will take years. <br /> Conversely, there is a limited opportunity to take advantage of the grant funding needed to meet <br /> current and future requirements of the stormwater permit. The grant will allow the City to <br /> procure more than enough devices to meet the 216 acre minimum area needed to comply with <br /> the new permit and help us meet the phased in total trash reduction requirements for stormwater <br /> collection systems.
