MINUTES Page 4 <br /> City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting — November 15, 2010 <br /> Proposed Should Another Ballot Proposition Legalizing Marijuana Qualify for the State <br /> Ballot. <br /> Deputy City Clerk Vivian Chiu pointed out that the proposed ordinance was revised <br /> for clarification after the agenda was printed and that copies were provided to the City <br /> Council. She read the revised title in its entirety for the record. <br /> This being the time and place for the Public Hearing on the above matter, City Manager <br /> Stephen Hollister provided background on the item and the extension options. He asked <br /> City Attorney Jayne Williams to clarify the options on the length of the moratorium and <br /> the majority vote requirement for enactment. <br /> Ms. Williams explained that the moratorium requires a four -fifths vote, or five <br /> affirmative votes this evening. The proposed moratorium would be for 22 months and <br /> 15 days, but the Council could adopt a shorter period. <br /> Councilmember Prola requested clarification whether the adoption requirement is four - <br /> fifths vote of the entire City Council or four -fifths vote of the members present. Ms. <br /> Williams confirmed that the requirement is four -fifths vote of the members present. <br /> Councilmember Souza requested a brief staff presentation for the public audience. Mr. <br /> Hollister introduced Senior Planner Kathleen Livermore. <br /> Ms. Livermore reported that staff has consulted with other similar-sized jurisdictions in <br /> California during the 45 -day moratorium and recommends that the City Council extend <br /> the moratorium for 22 months and 15 days. The moratorium would allow time for staff <br /> to provide the City Council with the most comprehensive regulatory and fiscal options <br /> for review and assessment. <br /> The Hearing was then opened to the public. <br /> Mike Katz, San Leandro resident, addressed the City Council, requesting the City <br /> Council to adopt a shorter moratorium and commenting that 10 months would provide <br /> sufficient time. Mr. Katz commented that the City should not dismiss medical <br /> marijuana as an opportunity for business. <br /> Darlene Evans, San Leandro resident, addressed the City Council, requesting the City <br /> Council to adopt a longer moratorium and commenting that the City should not get <br /> involved in the marijuana business. <br /> There being no further comments from the public, and without objection, the Public <br /> Hearing was closed. <br /> A motion was made by Councilmember Souza, seconded by Councilmember <br /> Starosciak, to adopt the ordinance as presented. <br />
