MINUTES Page 4 City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting — November 15, 2010 Proposed Should Another Ballot Proposition Legalizing Marijuana Qualify for the State Ballot. Deputy City Clerk Vivian Chiu pointed out that the proposed ordinance was revised for clarification after the agenda was printed and that copies were provided to the City Council. She read the revised title in its entirety for the record. This being the time and place for the Public Hearing on the above matter, City Manager Stephen Hollister provided background on the item and the extension options. He asked City Attorney Jayne Williams to clarify the options on the length of the moratorium and the majority vote requirement for enactment. Ms. Williams explained that the moratorium requires a four -fifths vote, or five affirmative votes this evening. The proposed moratorium would be for 22 months and 15 days, but the Council could adopt a shorter period. Councilmember Prola requested clarification whether the adoption requirement is four - fifths vote of the entire City Council or four -fifths vote of the members present. Ms. Williams confirmed that the requirement is four -fifths vote of the members present. Councilmember Souza requested a brief staff presentation for the public audience. Mr. Hollister introduced Senior Planner Kathleen Livermore. Ms. Livermore reported that staff has consulted with other similar-sized jurisdictions in California during the 45 -day moratorium and recommends that the City Council extend the moratorium for 22 months and 15 days. The moratorium would allow time for staff to provide the City Council with the most comprehensive regulatory and fiscal options for review and assessment. The Hearing was then opened to the public. Mike Katz, San Leandro resident, addressed the City Council, requesting the City Council to adopt a shorter moratorium and commenting that 10 months would provide sufficient time. Mr. Katz commented that the City should not dismiss medical marijuana as an opportunity for business. Darlene Evans, San Leandro resident, addressed the City Council, requesting the City Council to adopt a longer moratorium and commenting that the City should not get involved in the marijuana business. There being no further comments from the public, and without objection, the Public Hearing was closed. A motion was made by Councilmember Souza, seconded by Councilmember Starosciak, to adopt the ordinance as presented.
