NOTICE OF EXEMPTION <br /> 1 CC P <br /> To: County Clerk From: City of San Leandro <br /> Alameda County City Clerk's Office <br /> 1106 Madison 835 East 14th Street <br /> Oakland, CA 94612 San Leandro, CA 94577 <br /> Project Title: Bicycle and Pedestrian Master Plan <br /> Project location — Citywide, City of San Leandro <br /> Description of project: An Update to the City's Bicycle and Pedestrian Master Plan <br /> Name of public agency approving project: City of San Leandro <br /> Name of person or agency carrying out project: City of San Leandro <br /> Exempt status: (Check One) <br /> x Statutory Exemption (state type and section number): California Public Resources Section <br /> 21083.3 (b) and CEQA Guideline Section 15183. Projects "Consistent with Community Plan or Zoning "; <br /> whereby the Bicycle and Pedestrian Master Plan is being updated pursuant to previous approved General <br /> Plan and Climate Action Plan policies and the General Plans certified EIR. <br /> • <br /> Reasons why project is exempt: Public Resources Code Section 21083.3. The project is also <br /> statutorily exempt from CEQA pursuant to CEQA Guideline Section 15183. Projects Consistent with <br /> Community Plan or Zoning. These two sections provide the City with an opportunity to adopt General Plan <br /> or zoning policies and then to apply those policies to specific projects that are consistent with the General Plan <br /> or zoning ordinance. <br /> The existing General Plan has Policy #14.01 Action A (Bikeway Plan Implementation) and policy # Action B <br /> (Capital Improvement Scheduling). Policy 14.01Action A states that the city shall "Maintain and implement a <br /> Citywide Bikeway Plan and update that Plan regularly as conditions and needs change." Policy 14.02 states <br /> that the City should aggressively seek funding for bikeway improvements and Policy 14.03 suggests that <br /> future trail alignments change ". The General Plan was adopted by the City Council after it certified an <br /> Environmental Impact Report (EIR) that analyzed all environmental issues in the Draft General Plan. <br /> The City has also adopted a Climate Action Plan. The Climate Action plans states in part: "Measures for action <br /> and consideration: continue to update and invest in the Bike and Pedestrian Master Plan (2004). Update and <br /> implement the master plan to create a network of safe routes for pedestrians and bicyclists to make the City <br /> more accessible through sustainable strategies ".
