• • vith all safety requirements of City, whether or not specifically set forth herein, including, but not limited to, those items set forth in "Exhibit A" and "Exhibit B," • attached hereto and made a part hereof by reference. Licensee shall pay City for any City inspection costa not included in the construction permit fees. The work to erect or lay said pipelines shall be commenced in good faith within not more than one (1) year from the execution of this Agreement,. and if not so commenced._ this Agreement shall be forthwith terminated and the license herein forfeited. 5. City reserves the right to vacate any public street, way, alley or place or portion thereof subject to the license described herein, without obligation or liability to Licensee and such vacation shall automatically terminate that portion of-this license effected by the vacated public street, way, alley or place, pro- vided that-City shall make available to Licensee under the same terms, conditions, and provisions of this license, a license to use an.alternate rnuta upon reasonably. convenient public streets,-ways, alleys and places, which alternate route shall be accepted without recourse by Licensee. 6. Licensee shall not Bell, or assign this license or any of the rights or privileges granted hereby without the consent of the City Council ofCity, nor shall this license or rights or privileges be sold, transferred or assigned except by a duly executed instrument in writing, filed in the office of the City • Clerk of City. Any licensed property .may be owned partly or wholly by persons, firms or corporations other than Licensee, but Licensee shall be solely reapon- sible for the operation and maintenance of such licensed property; and Licensee holds itself responsible to City for the full performance and observance of the terms and conditions of this license by such ocher owner°. 7. City reserves the right to improve any public street, way, alley or place, or portion thereof, over and within which this license is granted, including the widening, change of grade, construction or reconstruction of such public street, way, alley or place, or any portion thereof, and there is further reserved to • City and any political subdivision or district within City the right to construct, reconstruct, install, repair and maintain, in any such public street, way, allay • or place, or portion thereof, any public improvement. The City Manager shall give notice to Licensee, or to the local manager or agent of Licensee, in advance of the fact that work is to be done pursuant -3- i
