DISCUSSION <br /> Public Works staff proposes the following options for consideration of a polystyrene food <br /> service ware ordinance: <br /> Option 1 — Ordinance with outreach and enforcement <br /> Cost: $10,000 for ordinance adoption and $13,000 for annual program costs. <br /> Adopt a polystyrene ban as other cities have done, with the exception that businesses would be <br /> specifically discouraged from using plastics #3 - #7 and compostable plastic products as <br /> alternatives. Staff would develop a plan similar to the Alameda, Hayward, and Livermore plans, <br /> perform the necessary CEQA process, notify affected businesses, and present the plan to the City <br /> Council for adoption. The plan would include an enforcement component that would fine <br /> businesses for non - compliance after a six (6) month grace period. The plan would also include <br /> active and ongoing outreach to food establishments, institutions, residents, and other City <br /> departments. The estimated one -time cost to adopt a polystyrene food service ware ordinance is <br /> approximately S10,000 for legal services and outreach development. Annual program <br /> administration would cost approximately $10,000 for staffing (208 hours), plus an additional <br /> $3,000 per year for outreach. The City Council would need to identify and appropriate funding <br /> for ordinance adoption and annual administration and outreach. Multi - lingual outreach would <br /> require additional funding. <br /> Option 2 - Ordinance with no enforcement and limited no -cost outreach <br /> Cost: S10,000 for ordinance adoption. <br /> Adopt a polystyrene ban as described in Option 1, but with no enforcement, and limited ongoing <br /> outreach and education. The ban would be mostly a symbolic gesture on the part of the City; <br /> customers would ultimately be responsible for enforcing the ban by refusing the products or <br /> discontinuing patronage with violators. The estimated one -time cost to adopt a polystyrene food <br /> service ware ordinance as described in Option 1 is approximately S10,000 for legal services and <br /> outreach development. Ongoing outreach would be limited to no -cost email blasts, website <br /> postings, and ACI billing inserts. Staff would incorporate outreach into existing programs and <br /> services to businesses and residents. There would be no active enforcement by City staff. <br /> Option 3 — Voluntary Program <br /> Cost: $3,000 annually for outreach. <br /> Staff would conduct education and outreach to encourage local food establishments to <br /> voluntarily eliminate polystyrene food service ware or offer recyclable or compostable options to <br /> their patrons. In addition, staff would promote recyclable, reusable, and compostable alternatives <br /> to polystyrene to businesses, residents, schools, and other organizations. The City would <br /> continue to ban polystyrene food service ware at City- sponsored events. <br /> 3 <br />
