1 <br /> CONDITIONS OF APPROVAL <br /> PLN2010 -00046 — Fulton Avenue @ Evergreen Avenue <br /> Clearwire LLC (applicant) and <br /> Pacific Gas & Electric Company (property owner) <br /> COMPLIANCE WITH APPROVED PLANS <br /> A. The project shall comply with Exhibits A and B, dated December 2, 2010, except as <br /> hereinafter modified. (Exhibit is on file at the City of San Leandro Development <br /> Services Department, 835 East 14th Street, San Leandro, California, 94577). <br /> Exhibit A — Site Plan <br /> Exhibit B — Elevations <br /> B. The applicant and/or property owner shall be responsible for assuring that any <br /> successor in interest who assumes responsibility for this zoning approval is informed <br /> of its terms and conditions. <br /> C. Construction shall commence within one year following the Board of Zoning <br /> Adjustments approval and shall be substantially completed one year thereafter. <br /> The proper Building Permits shall be obtained from the Building and Safety <br /> Services Division of the Community Development Department. <br /> I1. USE RESTRICTIONS <br /> A. This Conditional Use approval permits installation of three (3) wireless <br /> communication antenna panels, three (3) internet service exchange points, and a <br /> supporting equipment rack. The antennas and exchange point dishes will be installed <br /> on the side of a new approximately 12 -foot tall extension to the existing PG &E <br /> transmission tower. <br /> B. The tower extension, antennas, internet exchange points and supporting cables and <br /> wires, shall all be painted to match the tower. <br /> C. The single supporting equipment rack will be located within an existing equipment <br /> compound enclosed by a 10 -foot tall solid redwood fence located near the base of <br /> the tower. <br /> D. The project shall remain in substantial compliance with the approved exhibits and <br /> plans. Any change to the project design or materials shall be subject to the review <br /> and approval of the Zoning Enforcement Official who may administratively <br /> approve or require review by the Board of Zoning Adjustments as a modification <br /> to appropriate application approval listed above. <br /> Agreement to Conditions December 2, 2010 <br /> PLN2010 -00046 Page 3 of 5 <br />
