Zoning Code Amendments -2- March 21, 2011 <br /> DA Uses, Definitions and Parking; SB2 <br /> Downtown Area (DA) Updates <br /> Since the adoption of the Downtown Transit Oriented Development Strategy and the related <br /> Downtown Area (DA) Zoning Districts in 2007, a number of minor adjustments to the Zoning <br /> requirements have accumulated that need to be addressed as a "clean up" effort. Certain uses <br /> that were not allowed under the new DA zoning, for example "Animal Grooming" and "Animal <br /> Sales ", or others that were permitted only with a Conditional Use Permit (CUP), such as "Cafes ", <br /> have since become considered by staff to be appropriate as outright permitted uses for the <br /> downtown area. <br /> In other cases. "Office. Business and Professional" were either too restrictive in the use or <br /> locational requirements, so that staff recommends these should be minimized or removed. For <br /> example, dental laboratories that are now more akin to medical office uses could not locate in <br /> many districts, especially the downtown, without a CUP. Filially, certain parking requirements <br /> for the DA are now to be phased out, per the original Zoning Code amendments in 2007 in <br /> Article 17, and the Planned Development Overlay status for several DA -zoned properties <br /> required clarification in Article 10. <br /> DISCUSSION <br /> • <br /> SB2 Fair Share Zoning Law <br /> SB2 establishes that emergency shelters can only be subject to those development and <br /> management standards that apply to other developments in the same zone, except that the local <br /> government may apply written, objective standards. San Leandro Housing and Planning staff <br /> negotiated with the State of California Office of Housing and Community Development to define <br /> the Homeless Shelters with the following standards: <br /> Homeless Shelters. Facility limited to 25 beds and subject to the following requirements: <br /> the facility has an adopted management plan that includes hours and stafng; the facility <br /> provides sufficient waiting room, parking and loading facilities,: and that 24 -hour male and <br /> female toilets, showers and private lockers are provided <br /> Staff proposes to amend Article 7 Industrial Districts, Section 2 -704 (IL Districts Use <br /> Regulations) to allow homeless shelters in the IL Industrial Light Zoning District and to add the <br /> above definition for Homeless Shelters in Article 3, Section 1 -304, Definitions. <br /> Downtown Area (DA) Updates <br /> In order to accommodate the proposed changes discussed above, a series of additions and strike <br /> outs are proposed to several Zoning Code sections. The actual proposed strike -out and added text <br /> are found in the attachments to the proposed ordinance. Staff notes that all other sections of the <br /> Code not amended or altered shall remain the same, and in full force and effect. <br /> The proposed ordinance will amend the following Articles of the Zoning Code per the following <br /> summaries: <br />
