Planning Commission Adjourned Regular Meeting Minutes February 17, 2011 <br /> Agenda No. 11 -02 Page 3 of 3 <br /> Commissioner Fitzsimons said that he had a similar question, in that it seemed those restrictions <br /> had been included for a reason, so that East 14th Street didn't present closed -off offices as <br /> opposed to active space with people coming and going. 1-le said that he hasn't compared the plans <br /> for the downtown changes against the zoning overlays Planner Barros referred to, but asked how <br /> freeing up space for ground -floor office use matches the conceptual illustrations of downtown <br /> development. Planner Barros said that the staff believed that market forces would determine the <br /> mix of retail stores, restaurants and other such uses. <br /> In response to a question from Commissioner Crow, Planner Barros explained that as a result of <br /> the proposed changes, the General Plan map and Zoning Map will be more in alignment than they <br /> have been. <br /> Commissioner Dlugosh asked who would hear the appeal if someone appeals a staff <br /> determination or decision. Planner Barros said that it would first go to the Zoning Enforcement <br /> Official. whose decision could then be appealed to the BZA. <br /> Planner Barros said that the proposed changes are considered a project and thus subject to CEQA. <br /> Accordingly, staff has prepared an Initial Study and Negative Declaration, and because no actual <br /> construction is involved, the project would have no impact.
