Planner Barros said that it would first go to the Zoning Enforcement
Official. whose decision could then be appealed to the BZA.
Planner Barros said that the proposed changes are considered a project and thus subject to CEQA.
Accordingly, staff has prepared an Initial Study and Negative Declaration, and because no actual
construction is involved, the project would have no impact. The California Department of Fish &
Game also has issued a "no effects" determination on this project.
Motion to open Public Hearing
Crory /Abero; 7 Aye, 0 No
With no speakers coming forward, Chair Collier invited a motion to close the public hearing.
Motion to close Public Hearing
Fitzsimons/Abero; 7 Aye, 0 No
Motion to forward the Negative Declaration of Zoning Code amendments
to City Council with a recommendation to adopt
Fitzsimons/Abero; 7 Aye, 0 No — Motion Passed
Motion to fonvard the proposed Zoning Code amendments
with Planning Commission comments
to City Council with a recommendation to approve
Abero /Reed; 7 Aye, 0 No — Motion Passed
ATTACHMENT A: EXCERPT OF DRAFT MINUTES FOR PLANNING COMMISSION
REGULAR MEETING, FEBRUARY 17, 2011
