IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO ORDINANCE NO. 2011 -006 ORDINANCE AMENDING SECTIONS OF THE SAN LEANDRO MUNICIPAL CODE RELATING TO ADMINISTRATIVE APPEALS HEARINGS RECITALS The City Council of the City of San Leandro does ORDAIN as follows: Section 1. Section 1 -3 -300 of Chapter 1 -3 of the San Leandro Municipal Code is hereby amended as follows (additions in underline; deletions in striL�„ gh): 1 -3 -300 MEMBERSHIP. The Board of Appeals shall be the "Administrative Hearing Body ", which shall mean three (3) City of San Leandro department manager level employees designated by the City Manager to hear and decide upon together, appeals held pursuant to this Chapter consi fowe. Section 2. Section 1 -3 -405 of Chapter 1 -3 of the San Leandro Municipal Code is hereby amended to delete subsection (d) as follows (additions in underline; deletions in s g h) : Section 3. Chapter 1 -9 of the San Leandro Municipal Code is hereby deleted in its entirety. Section 4. Section 1 -12 -420 of Chapter 1 -12 of the San Leandro Municipal Code is hereby amended as follows (additions in underline; deletions in stril ough): 1 -12 -420 HEARINGS. (a) Any person appealing a notice of violation must obtain a "request for hearing" form from the City Clerk's Office : . ! • .. - ! - - - a n d d return it fully completed within fifteen (15) days from the date of service of the notice of violation. At the time of returning the request for hearing form to the City Clerk's Office r ............:*.. Development DepaFtment , the person or entity requesting the appeals hearing shall pay an appeals processing fee established by the City Council. Failure to submit a completed appeals form or to pay the appeals processing fee constitutes a waiver of the right to appeal the notice of violation and a failure to exhaust administrative remedies.
