Cooke, Principal Engine r 4 <br /> Engineering and Transportation Department <br /> SUBJECT PROJ ECT /PROJECT DESCRI PTION: <br /> RESOLUTION SUMMARILY VACATING A PORTION OF THE PUBLIC RIGHT -OF- <br /> WAY OF FAIRWAY DRIVE (AT 2500 MERCED STREET). <br /> SUMMARY AND RECOMMENDATION <br /> Staff recommends adoption of a Resolution summarily vacating a portion of the public right -of- <br /> way on Fairway Drive (at 2500 Merced Street). <br /> BACKGROUND <br /> Sandis Engineering, on behalf of Kaiser Permanente LLC, owner of 2500 Merced Street, has <br /> requested that the City vacate a portion of public right -of -way on Fairway Drive (at 2500 Merced <br /> Street) as shown on the attached Exhibit A to accommodate the proposed Kaiser San Leandro <br /> Medical Center. The area to be vacated is a triangular area approximately 141.3 square feet. <br /> Kaiser owns the parcel that abuts the area to be vacated. <br /> The State of California Streets and Highways Code sets the authority and procedures for street, <br /> highway, and easement summary vacation. The procedure for summary vacation is outlined in <br /> Part 3, Division 9 of the Streets and Highways Code. Per Chapter 4 of Part 3, Division 9, <br /> Section 8334 of the Streets and Highways Code, the legislative body of the local agency may <br /> summarily vacate a portion of public right -of -way if there is an excess of right -of -way of a street <br /> or highway not required for street or highway purposes. <br /> Analysis <br /> Fairway Drive is an arterial roadway through the city that includes a bridge over the 1 -880 <br /> freeway. A one -way frontage road between Miller Street and 1 -880 runs along on either side of <br /> the bridge to access the rear of 2500 Merced (the Kaiser parcel) and 1700 Fairway (currently <br />
