PM 9862 — 2400 Marina Blvd. 2 May 2, 2011 <br /> The applicant has provided Conditions, Covenants and Restrictions (CC &R's) that specify the <br /> responsibilities and the continued maintenance of the common property, structures on the <br /> property, and perimeter fencing. <br /> The sidewalk repair and undergrounding work has been completed and the Parcel Map has been <br /> approved by the City Surveyor and City Engineer. <br /> Current City Council Policy <br /> Title VII, Chapter 1 of the San Leandro Municipal Code and the Subdivision Map Act set the <br /> authority and procedure for processing parcel maps. <br /> Applicable General Plan Policy <br /> The Parcel Map complies with the General Plan. <br /> Permits and /or Variances Granted <br /> On June 19, 2008 the Board of Zoning Adjustments granted a Conditional Use Permit allowing <br /> conversion of the property to condominiums. On December 4, 2008, the Board of Zoning <br /> Adjustments modified the Permit by deleting Conditions No. 4 and No. 13 relating to street <br /> dedication and street widening. <br /> Environmental Review <br /> Parcel Map 9862 is categorically exempt from the environmental review requirements of CEQA <br /> under Class 15, Minor Land Subdivisions, of Title 28, Chapter 1 of the San Leandro <br /> Administrative Code. <br /> • Summary of Public Outreach Efforts <br /> Public notification was made as part of the Conditional Use Permit process. The following <br /> public outreach was performed: a legal advertisement for a Public Hearing was placed in the <br /> Daily Review newspaper; notification letters were mailed to the property owners and business <br /> owners within 300 feet of the subject property, the Mulford Gardens' Improvement Association <br /> and the Marina Action Committee; and public notification placards were posted on the utility <br /> poles adjacent to and near the subject property. <br /> Fiscal Impact <br /> All of the associated costs in the preparation and processing of the Parcel Map will be paid by <br /> the applicant. <br />
