IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2011 -087 <br /> RESOLUTION SUMMARILY VACATING A PORTION OF THE PUBLIC RIGHT -OF -WAY <br /> OF FAIRWAY DRIVE (AT 2500 MERCED STREET) <br /> Recitals <br /> The City Council of the City of San Leandro does RESOLVE as follows: <br /> That the City Council hereby elects to proceed under the provisions of Part 3 Public <br /> Streets, Highways, and Service Easements Vacation, Division 9. Change of Grade and Vacation <br /> of the California Streets and Highways Code. <br /> WHEREAS, portions of the public right -of -way to be summarily vacated by this <br /> resolution are located along Fairway Drive, a public street in the City of San Leandro, Alameda, <br /> County, California, officially known and designated as such. The portion of the street so <br /> proposed to be summarily vacated and abandoned is described in Exhibit A and Exhibit B, <br /> attached hereto, and made a part hereof; and <br /> WHEREAS, the portion of the public right -of -way of Fairway Drive is not required for <br /> street or utility purposes and therefore is excess right -of -way of a street not required for street <br /> purposes and there are no in -place public utility facilities that are in use and would be affected by <br /> the vacation; and <br /> WHEREAS, the proposed vacation has been found to be categorically exempt from the <br /> California Environmental Quality Act (CEQA) requirements in accordance with CEQA Section <br /> 15061, Subsection (b) (3); and <br /> WHEREAS, said summary vacation is made under Chapter 4 (Summary Vacation) Part 3 <br /> Division 9, of the Califomia Streets and Highways Code. <br /> NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> 1. That the City Council hereby orders the summary vacation of the herein above <br /> described portion of public right -of -way. <br /> 2. That the City Clerk shall cause a certified copy of this resolution to be recorded in <br /> the Office of the Recorder of Alameda County, California, immediately upon its <br /> adoption. <br /> 3. That from and after the date of recordation of this resolution, said portions of <br /> right -of -way vacated no longer constitute a public right -of -way. <br />
