IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2011 -087 RESOLUTION SUMMARILY VACATING A PORTION OF THE PUBLIC RIGHT -OF -WAY OF FAIRWAY DRIVE (AT 2500 MERCED STREET) Recitals The City Council of the City of San Leandro does RESOLVE as follows: That the City Council hereby elects to proceed under the provisions of Part 3 Public Streets, Highways, and Service Easements Vacation, Division 9. Change of Grade and Vacation of the California Streets and Highways Code. WHEREAS, portions of the public right -of -way to be summarily vacated by this resolution are located along Fairway Drive, a public street in the City of San Leandro, Alameda, County, California, officially known and designated as such. The portion of the street so proposed to be summarily vacated and abandoned is described in Exhibit A and Exhibit B, attached hereto, and made a part hereof; and WHEREAS, the portion of the public right -of -way of Fairway Drive is not required for street or utility purposes and therefore is excess right -of -way of a street not required for street purposes and there are no in -place public utility facilities that are in use and would be affected by the vacation; and WHEREAS, the proposed vacation has been found to be categorically exempt from the California Environmental Quality Act (CEQA) requirements in accordance with CEQA Section 15061, Subsection (b) (3); and WHEREAS, said summary vacation is made under Chapter 4 (Summary Vacation) Part 3 Division 9, of the Califomia Streets and Highways Code. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: 1. That the City Council hereby orders the summary vacation of the herein above described portion of public right -of -way. 2. That the City Clerk shall cause a certified copy of this resolution to be recorded in the Office of the Recorder of Alameda County, California, immediately upon its adoption. 3. That from and after the date of recordation of this resolution, said portions of right -of -way vacated no longer constitute a public right -of -way.
