• •
G. [ §207] Duration Of Agreement
This Agreement shall remain in full force and effect for a period
of five years from the date hereof, provided that in the event that.
UACI has, within four years of the date of this Agreement, applied to
the City for approval of a General Development Plan, then this
Agreement shall be extended without further act of the parties for a
period of two additional years, to a total of seven years. If so
extended, the City may terminate this Agreement at any time during the
last two years of the extended term in the event that UACI does not
use reasonable diligence to complete the development of the Subject
Property within the extended term of this Agreement.
H. [ §208] Further Dedications
City has determined that nothing contained in this Agreement
requires the dedication or reservation of any portion of the Subject
Property for public purposes. The foregoing notwithstanding, the City
shall retain the right to require the future dedication or reservation
of a portion of the Subject Property for public purposes, if such
dedication or reservation is otherwise consistent with the terms,
conditions and purposes of this Agreement.
I. [ §209] Effect Upon Other Agreements
Neither the execution or delivery of this Agreement, nor
compliance with the terms hereof, will constitute a default, waiver or
excuse for nonperformance under any other agreement to which UACI is a
party as of the date of this Agreement.
UACI Dev.
