• TITLE VII ® MAPS, BUILDINGSND SUBDIVISIONS <br /> • <br /> Chapter 3 Zoning <br /> Section 7- 3- 516.2: A protective barrier not less than four (4) <br /> feet high shall be maintained around the area occupied by every <br /> private swimming pool in an R or 0 District and the spaces used in <br /> connection therewith, and every entrance door or gateway shall be <br /> provided with an automatic latch to prevent unguarded access from <br /> the street or from adjacent property. The requirement of such a <br /> barrier. around the pool itself shall not apply where the pool is <br /> equally well protected against such unguarded access by barriers <br /> 'surrounding a larger portion or all of the building site. <br /> Section 7 -3- 516.5: ACCESSORY STRUCTURES. Accessory structures <br /> are permitted in any district. No accessory structure shall <br /> occupy a required yard unless specifically permitted by this <br /> Chapter. (Legislative History: Ord. No. 78 -50, 10/9/78) <br /> Section 7 -3- 516.6: OPERATING ACCESSORY STRUCTURES IN REQUIRED <br /> YARDS: - <br /> (a) The Board of Zoning Adjustments, in informal hearing, <br /> may permit the installation of an operating accessory structure in <br /> a required yard in any case where the property owner is able to <br /> demonstrate that such installation is necessary for the beneficial <br /> development of the property and will not be detrimental to <br /> neighboring properties or to the public health, safety or <br /> welfare. Notice of the time, place and purpose of such hearing <br /> shall be posted on or adjacent to the property involved and mailed <br /> to the owners of adjacent properties. <br /> (b) The installation of an operating accessory structure in <br /> a required yard may be permitted or required in conjunction with <br /> the approval of an application for variance or conditional use in <br /> any case where such installation is necessary for the beneficial <br /> development of the property, the protection of other property in <br /> the vicinity or protection of the public health, safety and <br /> welfare. No. 78 -50, 10/9/78) <br /> Section 7- 3- 516.7: ACCESSORY TELEVISION SATELLITE RECEIVING • <br /> ANTENNAS. <br /> (a) Installation of antennas in excess of three (3) feet in <br /> diameter, intended for the purpose of receiving television signals <br /> relayed by satellite is permitted in any zoning district upon <br /> approval of the Site Development Subcommission. <br /> (b) Notwithstanding Section 7 -3 -505 to the contrary, the <br /> installation of such antennas is subject to all applicable height <br /> limitations set forth in this Chapter and to any additional <br /> limitations on height and location deemed by the Site Development <br /> Subcommission to be necessary. <br /> (c) The installation of such antennas shall not be <br /> permitted within a required front yard or required streetside side <br /> yard. Accessory <br /> buildings as defined in Section 7- 3- 150(a) and as regulated within <br /> this Chapter are permitted in any district. No detached accessory <br /> building shall occupy a required front yard or a required <br /> streetside side yard or be located within five (5) feet of any <br /> dwelling.
