TITLE VII MAPS, BUILDINGS AND SUBDIVISIONS <br /> Chapter 3 Zoning <br /> Section 7 -3 -660: APPEALS. Whenever provision for an appeal is made <br /> in this Chapter, the appeal may be taken by any person aggrieved with <br /> the decision appealed from and the following regulations shall <br /> apply. <br /> Section 7 -3 -661: APPEAL PERIOD. An appeal will be valid only if <br /> Notice of Appeal is filed with the agency appealed to within fifteen <br /> (15) days from the date of the action or decision appealed. <br /> Section 7 -3 -662: APPEALS - CONTENT OF NOTICE. Every Notice of <br /> Appeal shall be in writing and shall be filed in duplicate with the <br /> agency to whom the appeal is made. <br /> • <br /> • <br /> Section 7- 3- 662.1: APPEALS - FEES. Every person filing an appeal <br /> shall pay to the agency with whom the appeal is filed such fees as the <br /> City Council shall, from time to time, establish by <br /> resolution. (Legislative History: Ord. No. 76 -39, 10/26/76) <br /> Section 7 -3 -663: APPEALS - TRANSMITTAL OF RECORD. The agency <br /> receiving the Notice of Appeal shall forthwith transmit a copy thereof <br /> to the Community Development Office, and said office shall make <br /> available to the agency receiving the appeal all of the documents <br /> constituting the record upon which the action was taken. <br /> Section 7 -3 -664: APPEAL STAYS PROCEEDINGS. The filing an appeal <br /> shall wholly vacate the action of the body appealed from and all <br /> proceedings pertaining thereto shall be stayed. (Legislative History: <br /> Ord. Ho. 84 -09, 3/19/84) <br /> Section 7 -3 -665: APPEALS - ACTION BY COUNCIL. The City Council shall <br /> hear and decide appeals from any action of the Planning Commission or <br /> the Board of Zoning Adjustments and may affirm or reverse the action, <br /> in whole or in part. The City Council shall not be limited in its <br /> review to that portion of the action complained of, but may consider <br /> the entire matter and in doing so may add, modify or delete conditions <br /> as it deems necessary or proper. (Legislative History: Ord. No. 84 -09, <br /> 3/19/84) <br /> Section 7 -3 -666: APPEALS - ACTION BY PLANNING COMMISSION. The <br /> Planning Commission shall hear and decide any matter brought before it <br /> by reference or on appeal concerning a use subject to approval of Site <br /> Development. <br /> Section 7 -3 -667: APPEALS - ACTION BY BOARD OF ZONING ADJUSTMENTS. <br /> The Board of Zoning Adjustments shall hear and decide any matter.., <br /> brought before iU on appeal concerning administrative action taken <br /> under Sections 7 -3 -630 through 7 -3 -633 of this Code. <br /> 3/22/84 -130- <br />
