SAN LEANDRO ADMINISTRATIVE CODE <br /> TITLE 5 COMMUNITY DEVELOPMENT <br /> Chapter 4 Development Agreements <br /> §5.4.610: DELEGATION OR REFERRAL TO PLANNING COMMISSION. The <br /> City Council may as set forth in the development•agreement itself: <br /> (i) reserve the review of the development agreement to itself; or <br /> (ii) delegate the review to the Planning Commission for a <br /> determination, and,. if not set forth in the agreement, the review <br /> shall be conducted by the Community Development Director. <br /> §5.4.615: PUBLIC HEARING. Either the Planning Commission, .the <br /> Community Development Director or the City Council, as the case may <br /> be,, shall conduct a public hearing at which the property owner must <br /> demonstrate good faith compliance with the terms of the agreement. <br /> The burden of proof on this issue is upon the property owner. <br /> §5.4.620: FINDINGS UPON PUBLIC HEARING. The City Council, <br /> Planning Commission or Community Development Director, as the case <br /> may be, shall determine upon the basis of substantial evidence <br /> whether or not the property owner has, for the period under review, <br /> complied in good faith with the terms and conditions of the <br /> agreement. <br /> 6/10/85 <br /> -10- • <br />
