[ §202] Zoning And Permitted Uses Of The Subject Property <br /> The Subject Property may be devoted to the following uses as a <br /> matter of right without the necessity of discretionary review except <br /> as required pursuant to § §203, 204, 205 and 206 of this Agreement: <br /> (a) commercial banks and savings and loan institutions subject <br /> to the limitations and restrictions of the general <br /> commercial ( "C -2 ") District; <br /> (b) restaurants, excepting "fast food" restaurants, 1 subject <br /> �r- <br /> to the limitations and restrictions of the general <br /> commercial ( "C -2 ") District; <br /> 1/ <br /> Definition of "fast food" restaurants include, but is not limited <br /> to those restaurants which: <br /> 1. Have special drive -up or drive -thru facilities for direct <br /> service for patrons in automobiles, or walk -up window for <br /> service outside the building; <br /> 2. Do a substantial majority of their business as take -out or <br /> stand -up counter services; or <br /> 3. Do not qualify for a class 41 license for alcoholic beverage <br /> sale because they•do not qualify as full service restaurants <br /> pursuant to Section 23038 of the State Business and <br /> Professions Code. <br /> UACI Dev.
