IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2011- RESOLUTION OF AWARD OF CONSTRUCTION CONTRACT TO GALLAGHER & BURK, INC. FOR THE MARINA BOULEVARD STREET REHABILITATION PROJECT, PROJECT NO. 10- 150 -38 -329, FEDERAL AID PROJECT NO. STPL - 5041(037). Recitals WHEREAS, the City of San Leandro did, on June 2, 2011, publicly open, examine and declare all sealed proposals or bids for doing the work described in Resolution No. 2011 -085 of the Council of said City adopted on May 2, 2011, which resolution is hereby expressly referred to for a description of said work and for all particulars relative to the proceedings under said resolution; and WHEREAS, said proposals were submitted to the Engineering and Transportation Director who has recommended that the proposal hereinafter mentioned is the lowest responsive bid of a responsible bidder for doing said work. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: 1) That upon the recommendation of the City Engineer, the City Council shall not waive the irregularities in Redgwick Construction, Inc.'s bid, and further finds that the bid protest submitted by Gallagher & Burk, Inc. upon the bid submitted by Redgwick Construction, Inc. has merit such that Redgwick Construction, Inc.'s bid is rejected as non - responsive; and 2) That the City Council hereby awards the contract for doing said work to the next lowest responsive and responsible bidder therefore, to wit: Gallagher & Burk, Inc., at the prices named in its bid on file in the Office of the City Clerk; and 3) That said City Council hereby rejects all other proposals or bids except that herein mentioned for award.
