Alexander, Port Attorney <br /> Port of Oakland <br /> 530 Water Street, 4 Floor <br /> Oakland, CA 94607 <br /> FOR RECORDER'S USE <br /> GRANT OF EASEMENT AND RELEASE <br /> This Grant of Easement and Release is made on , 200_, by • <br /> ([collectively] "Grantor"), to the City of Oakland, a <br /> municipal corporation, acting by and through its Board of Port Commissioners (the "Port"), is <br /> with reference to the following facts: <br /> A. Grantor owns real property in Alameda County, California ( "Grantor's <br /> Property"). The legal description for Grantor's Property is attached as Exhibit "A ". Grantor's <br /> Property includes the air space above it. <br /> B. The Port owns and operates the Oakland International Airport in Alameda <br /> County, California (the "Airport"). The legal description for the Airport is attached as <br /> Exhibit "13". <br /> C. The Port and the City of San Leandro ( "City") have entered into a Settlement <br /> Agreement dated as of November 7, 2000 ( "Settlement Agreement "). The Settlement <br /> Agreement includes provisions for the Port to make payments for the City's management and <br /> implementation of the City's Residential Airport Noise Insulation Program, and, in exchange for <br /> grants of easement and release, to make payments for the City's costs of constructing noise <br /> insulation improvements for the residential units that the City selects for insulation. <br /> D. Grantor has accepted the City's offer that Grantor participate in the City's <br /> Residential Airport Noise Insulation Program, and Grantor and the City have agreed that in <br /> exchange for the City's agreement to provide at no cost to Grantor certain modifications to the <br /> residential structures on Grantor's Property that are intended to reduce aircraft noise heard inside <br /> the structures, Grantor will deliver to the Port this Grant of Easement and Release. <br /> GRANT OF EASEMENT AND RELEASE <br /> 1 <br />
