Alexander, Port Attorney <br /> Port of Oakland <br /> 530 Water Street, 4th Floor <br /> Oakland, CA 94607 <br /> GRANT OF EASEMENT AND RELEASE <br /> This Grant of Easement and Release is made on , 200_, <br /> (the "Grantors ") and the City of Oakland, a municipal corporation acting <br /> by and through its Board of Port Commissioners (the "Port") with reference to the following <br /> facts: <br /> A. Grantors own real property in Alameda County, California ( "Grantors' <br /> Property"). The legal description for Grantors' Property is attached as Exhibit "1 ". Grantors' <br /> Property includes the air space above it. <br /> B. The Port owns and operates the Metropolitan Oakland Tnternational Airport in <br /> Alameda County, California (the "Airport"). The legal description for the Airport is attached as <br /> Exhibit "2 ". <br /> C. Grantors have accepted the Port's offer to participate in a noise insulation <br /> program under which the Port, at no cost to Grantors, will make changes to the home on <br /> Grantors' Property. These changes are intended to reduce aircraft noise heard inside the home. In <br /> consideration for the opportunity to participate in the program, Grantors have agreed to give the <br /> Port the Easement described below. <br /> NOS', THEREFORE, the parties agree as follows: <br /> Section 1. Grant of Easement <br /> For valuable consideration, Grantors grant to the Port a perpetual, nonexclusive Easement <br /> over Grantors' Property for noise and other negative impacts resulting from aircraft flying to and <br /> from, and other operations at the Airport ( "Airport Operations "). This Easement specifically <br /> permits the imposition of noise and other negative impacts, including light, smoke, air currents, <br /> electronic or other emissions, vibrations, discomfort, inconvenience, interference with use and <br /> enjoyment resulting from Airport Operations producing noise up to the Maximum Approved <br /> Noise Levels as defined herein.
