BILL NO. <br />An act to amend Section 33210.5 of the Health and Safety Code, relating to <br />redevelopment of the County of Alameda -City of San Leandro Joint Redevelopment Project. <br />LEGISLATIVE COUNSEL'S DIGEST <br />[to be inserted] <br />The people of the State of California do enact as follows: <br />SECTION 1. The Legislature finds and declares all of the following: <br />(a) In 1993, the County of Alameda and the City of San Leandro jointly adopted the <br />Redevelopment Plan for the County of Alameda -City of San Leandro Redevelopment Project, <br />establishing a specified project area partly within the City of San Leandro and partly within the <br />unincorporated territory of the County of Alameda. <br />(b) In 2000, the Legislature enacted Health and Safety Code Section 33210.5, <br />pursuant to which: <br />(1) the Board of Supervisors of the County of Alameda has been designated as the <br />legislative body, and the Alameda County Redevelopment Agency has been designated to <br />exercise exclusive redevelopment powers, with respect to the unincorporated portion of the <br />project area; and <br />(2) the City Council of the City of San Leandro has been designated as the legislative <br />body, and the San Leandro Redevelopment Agency retains the authority to exercise exclusive <br />redevelopment powers, with respect to the portion of the project area within the city. <br />(c) Pursuant to Chapters 5 and 6 of the 2011 -12 First Extraordinary Session, the <br />Legislature added Parts 1.8, 1.85, and 1.9 of Division 24 of the Health and Safety Code by which <br />each redevelopment agency in the State, including the Alameda County Redevelopment Agency <br />and the San Leandro Redevelopment Agency, will be dissolved unless the community that <br />established the redevelopment agency participates in the alternative voluntary redevelopment <br />program set forth in Part 1.9 of Division 24 of the Health and Safety Code by enacting a <br />specified ordinance and thereafter making specified remittance payments. <br />(d) In light of the special redevelopment jurisdiction structure for the above described <br />redevelopment plan and project area as authorized by Health and Safety Code Section 33210.5, it <br />is necessary to harmonize the purpose and intent Chapters 5 and 6 of the 2011 -12 First <br />Extraordinary Session with Health and Safety Code Section 33210.5 to enable continued <br />redevelopment jurisdiction and exercise of powers by the Alameda County Redevelopment <br />Agency and /or the San Leandro Redevelopment Agency to the extent that the community that <br />created the respective redevelopment agency is in compliance with, and regardless of whether <br />the community that created the other redevelopment agency is in compliance with, the alternative <br />voluntary redevelopment program set forth in Part 1.9 of Division 24 of the Health and Safety <br />Code. <br />SECTION 2.
