IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2011- <br />RESOLUTION AFFIRMING THE SANITARY SEWER CONNECTION FEES FOR NEW <br />CONSTRUCTION AND AMENDING THE SAN LEANDRO ADMINISTRATIVE CODE <br />TITLE 12, CHAPTER 5 RELATING TO UNIFORM WASTEWATER DISCHARGE <br />REGULATIONS <br />Recitals <br />WHEREAS, the City of San Leandro Administrative Code Title 12 Chapter 5 contains <br />provisions for a connection fee to be charged when wastewater load is added to the sanitary <br />sewer system; and <br />WHEREAS, the City of San Leandro was awarded a $75,000 grant by the Metropolitan <br />Transportation Commission (MTC) to study the impacts on infrastructure, including the sanitary <br />sewer system, of higher density in the downtown Transit Oriented Development (TOD) area; and <br />WHEREAS, the City has used the grant money to commission a TOD Infrastructure <br />Study; and <br />WHEREAS, the City has also commissioned a Wastewater Capacity Charge Study; and <br />WHEREAS, the Wastewater Capacity Charge Study considers all costs of expanding the <br />capacity of the sanitary sewer system, including the projects identified by the TOD Infrastructure <br />Study, and proposes that the sanitary sewer connection fee be set to cover these costs. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />1. That the above statements are true. <br />2. Affirms that the Sanitary Sewer Connection Fee set by the Wastewater Capacity <br />Charge Study and now included in Title 6, Chapter 4 of the San Leandro <br />Administrative Code, is adequate to meet the needs of the City's Downtown <br />TOD. <br />3. Amends the San Leandro Administrative Code Title 12 Chapter 5 Section 115 by <br />adding the following: <br />(i) The Sanitary Sewer Connection Fee shall be modified each July 1 st by <br />an amount equal to either the amount shown in the Wastewater <br />Capacity Charge Study (2010) or the percentage change in the <br />Consumer Price Index (CPI) for the San Francisco Bay Area as <br />G:\ Items In Process \SEP 06 \SS Connection Fees \Set SS Connection Fee RES.Docx <br />
