3. The notice to record owners of property will contain: The reason for the proposed re <br />purposing of previously approved wastewater rates increases; and the date, time, and <br />location of the public hearing where affected parcel owners may submit their protest to the <br />proposal. <br />WHEREAS, if after complying with Prop. 218's procedural requirements a majority protest <br />to the proposed rate repurposing is received, the City may not repurpose the previously approved <br />rate increases unless it complies with the procedural requirements of Prop. 218 again. If, however, <br />a majority protest is not received, then the City may legally use monies from the previously <br />approved sewer /wastewater rate increases for a different purpose, and the City Manager, either on <br />her own, or at the City Council's request, may bring an action item for City Council consideration <br />to create a fund to reimburse the costs to reconnect private sewer laterals to City sewer mains; and <br />WHEREAS, the City Council received a staff report and presentation on the need for the <br />proposed repurposing of rates. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />That the City Manager or her designee is authorized to mail the required notice of the <br />proposed repurpose of sewer and wastewater treatment rate increases and that a public hearing will <br />be held November 21, 2011; and <br />That the City Council sets the minimum 45 day protest period to run from October 5, 2011 <br />to November 21, 2011 to receive written protests to the proposed repurpose of sewer and <br />wastewater treatment rate increases; and <br />That November 21, 2011, 7:00 p.m., or as soon thereafter at San Leandro City Hall, 835 E. <br />14' Street, San Leandro, California is the date, time and location of the public hearing to receive all <br />written protests to the proposal. <br />Introduced by Councilmember and passed and adopted this 19th day <br />of September, 2011, by the following called vote: <br />Members of the Council: <br />AYES: <br />NOES: <br />ABSENT: <br />ATTEST: <br />Marian Handa, City Clerk <br />
