Polystyrene Foam Food Service Ware Ordinance 4 September 19, 2011 <br />and provided public comments indicating that the ordinance would cause financial hardship on <br />local small businesses. They suggested a two -year grace period before the ordinance becomes <br />effective. The item was continued to the July meeting so that staff could meet with <br />representatives from the business community to outline a public outreach and education <br />program. <br />The Rules and Communications Committee received a second draft of the ordinance at the <br />meeting on July 25, 2011. The draft ordinance was revised based on input from the Committee <br />and the business community. The Committee recommended bringing the item to the City <br />Council in September with an effective date of November 1, 2012 for the ordinance. There were <br />no members of the public in attendance but written comments from a local business and the <br />California Restaurant Association were provided to the Committee. <br />Applicable General Plan Policy <br />Action 27.01 -A: Source Reduction and Recycling Programs. <br />Permits and /or Variances Granted <br />Not applicable. <br />Environmental Review <br />An Environmental Declaration — Notice of Exemption was filed with the Alameda County <br />Clerk's Office on August 11, 2011. <br />Code Compliance Review <br />Not applicable. <br />Board /Commission Findings <br />Not applicable. <br />Summary of Public Outreach Efforts <br />Staff sent a brochure to approximately 250 affected food establishments on May 5, 2011. The <br />brochure provided a link to the City's website where additional information could be found. In <br />addition, businesses were invited to attend a City Council work session on May 23, 2011 where <br />the item was presented and discussed. Staff met with members of the business community on <br />June 23, 2011 and on June 27, 2011 to discuss the item. Information, including a copy of the <br />ordinance, was sent to interested parties via email on July 7, 2011, July 26, 2011, and September <br />6, 2011. <br />Fiscal Impact <br />The development and distribution of public outreach for the ordinance will cost approximately <br />$3,000. Existing funding will be used as identified in the FY 2011 -12 budget for the Recycling <br />Program. <br />Budget Authority <br />Not applicable. <br />
