b. The Recipient's insurance coverage shall be primary insurance as <br /> respects the City, its officers, officials, employees and volunteers. <br /> Any insurance or self - insurance maintained by the City, its <br /> officers, officials, employees or volunteers shall be excess of the <br /> Recipient's insurance and shall not contribute with it. <br /> c. Any failure to comply with reporting provisions of the policies <br /> shall not affect coverage provided to the City, its officers, officials, <br /> employees or volunteers. <br /> d: The Recipient's insurance shall apply separately to each insured <br /> against whom claim is made or suit is brought, except with respect <br /> to the limits of the insurer's liability. <br /> 2. Workers' Compensation and Employers Liability Coverage. <br /> The insurer shall agree to waive all rights of subrogation against the City, <br /> its officers, officials, employees and volunteers for losses arising from <br /> work performed by the Recipient for the City. <br /> 3. Professional Liability. <br /> Recipient shall carry professional liability insurance in an amount deemed <br /> by the City to adequately protect the Recipient against liability caused by <br /> negligent acts, errors or omissions on the part of the Recipient in the <br /> course of performance of the services specified in this Agreement. <br /> 4. All Coverages. <br /> Each insurance policy required by this clause shall be endorsed to state <br /> that coverage shall not be suspended, voided, canceled by either party, <br /> reduced in coverage or in limits except after thirty (30) days' prior written <br /> notice by certified mail, return receipt requested, has been given to the <br /> City. <br /> (e) Acceptability of Insurers.
