EXHIBIT E <br /> GENERAL FEDERAL /STATE CONDITIONS <br /> COMMUNITY DEVELOPMENT BLOCK GRANT <br /> (Capital Improvement Projects) <br /> • <br /> 1. GOVERNMENTAL RF.GIJI.ATIONS. To the extent that this Agreement may be funded <br /> by fiscal assistance from another governmental entity, Recipient shall comply with all applicable <br /> rules and regulations to which City is bound by the terms of such fiscal assistance program. In <br /> particular, Recipient agrees to comply with all applicable provisions of the Housing and <br /> Community Development Act of 1974 (Public Law 93 -383) and regulations promulgated <br /> pursuant thereto. <br /> 2. RECORDS. Records must be kept accurate and up -to -date. Recipient's records shall be <br /> made available for review by the City, HUD or the designee. Recipient shall be responsible to <br /> maintain, for not less than three (3) years after completion of this Agreement, all records <br /> pertaining to this Agreement, including subcontracts and expenditures, and all other financial and <br /> property records. <br /> 3. AIJDITS AND INSPECTIONS. <br /> A. Recipient shall at any time during normal business hours and as often as the City, <br /> HUD and the Comptroller General of the United States may deem necessary, make available to <br /> their representatives for examination all of Recipient's records with respect to all matters covered <br /> by this Agreement and shall permit these representatives to audit, examine and make excerpts or <br /> transcripts from such records, and to make audits of all documents and conditions relating to this <br /> Agreement. All costs are subject to the eligibility requirements of HUD. <br /> B. Recipient shall permit and facilitate observation and inspection of the work and <br /> records at Recipient's principal office and job site by City, its employees and public authorities <br /> during reasonable business hours. <br /> 4. CONFI,ICT OF INTEREST. <br /> A. Recipient certifies that no member of, or delegate to the Congress of the United <br /> States shall be permitted to share, or take part in this Agreement or in any benefit arising <br /> therefrom. <br /> B. Recipient certifies that no member, officer, or employee of the City of San <br /> Leandro, or its designees or agents, no member of the San Leandro City Council, and no other <br /> public official of the City of San Leandro who exercises any functions or responsibilities with <br /> Exhibit E <br /> Page 1 of 10 <br />
