Resolution - Council <br />File Number: 11 -367 Agenda Section: PUBLIC HEARINGS — CITY <br />COUNCIL <br />Agenda Number: <br />TO: City Council <br />FROM: Lianne Marshall <br />Interim City Manager /Executive Director <br />BY: Mike Bakaldin <br />Public Works Director <br />FINANCE REVIEW: Not Applicable <br />TITLE: ADOPT: Resolution Amending the Title of Chapter 11 of Title 8, and Sections <br />8.11.100, 8.11.200, 8.11.350, 8.11.400 and 8.11.450 of the City of San <br />Leandro Administrative Code Related to the City's Procedure to Reimburse <br />Costs a Property Owner Incurs to Reconnect the Private Sewer Lateral to the <br />City's Sewerage System <br />Resolution Amending the Title of Chapter 11 of Title 8, and Sections 8.11.100, 8.11.200, <br />8.11.350, 8.11.400 and 8.11.450 of the City of San Leandro Administrative Code Related to <br />the City's Procedure to Reimburse Costs a Property Owner Incurs to Reconnect the Private <br />Sewer Lateral to the City's Sewerage System <br />WHEREAS, the City Council of the City of San Leandro approved the reimbursement of <br />private sewer lateral reconnection costs to property owners and Users of the City's sewerage <br />system when the City Engineer determines the only viable option is to relocate a City <br />sewerage system main line; and <br />WHEREAS, the City Council of the City of San Leandro authorized staff to engage in a <br />Proposition 218 process to determine whether a majority protest would be achieved against <br />the re- purposing of previously approved sewer and wastewater rate increases towards <br />reimbursing property owners the costs to reconnect their upper laterals from the Premises to <br />the lower lateral; and <br />WHEREAS, in accordance with Proposition 218, the City Council opened the requisite 45 <br />-day protest period, held an open and noticed public hearing to receive protests, and after <br />having closed the public hearing, and received the City Clerk's count of the returned <br />protests, a majority protest does not exist (City Clerk's initials: ); and <br />WHEREAS, the City Council desires these amendments to Title 8, Chapter 11 of the <br />City of San Leandro Page 1 Printed on 11/15/2011 <br />
