File Number: 11 -361 <br />WHEREAS, the MND was circulated for a 30 -day public review from October 14, <br />2011 to November 14, 2011 and, by separate Resolution, the City Council has made <br />findings and adopted the MND as an objective and accurate document that reflects the <br />independent judgment of the City in the identification, discussion and mitigation of the <br />environmental impacts of the Project; and <br />WHEREAS, the General Plan Land Use Map designates the site as Office and, in <br />order to allow for the Project, with a proposed density of 23 dwelling units per acre, the <br />General Plan Land Use Map designation for the Property would need to be amended from <br />Office (OF) to High Density Residential (HDR) (which allows from 19 to 25 units per acre) as <br />described in more detail in Exhibit A , attached hereto and incorporated herein; and <br />WHEREAS, the Project application also includes a proposed vesting tentative map <br />together with its provisions for its design and improvements; and <br />WHEREAS, the Project also requires the approval of a Planned Development Project <br />entitlement, pursuant to 3 -1012 of the Zoning Code, and satisfies all the requisite findings as <br />further explained in the staff report associated with this Resolution; and <br />WHEREAS, on October 20, 2011, by Resolution No. 2011 -001 PC, the Planning <br />Commission made the necessary findings and recommended that the City Council approve <br />the proposed General Plan Land Use Map Amendment and the Planned Development <br />Project entitlement; and <br />WHEREAS, on November 21, 2011 the City Council conducted a properly noticed <br />public hearing to consider approval of the Project, including, in addition to this Resolution, an <br />amendment to the Zoning Map; and <br />WHEREAS, the documents incorporated herein by reference are available for review <br />in the City Planning department at the San Leandro City Hall, file PLN2009 -00006 during <br />normal business hours. The location and custodian of the draft Mitigated Negative <br />Declaration, including comments and responses, and other documents that constitute a <br />record of proceedings for the Project, is the City of San Leandro, 835 E. 14th Street, San <br />Leandro, CA 94577. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />Section 1 . The foregoing recitals are true and correct and made a part of this Resolution. <br />Section 2 Findings for the General Plan Land Use Map Amendment As required under <br />State law, the General Plan and the City Municipal Code, the City Council finds the following: <br />A.
