Page 2 <br /> FY 2011/12 TFCA Agreement <br /> Project No 11ALAl2 <br /> • <br /> City of San Leandro <br /> Sponsor shall submit a report to the Alameda CTC within two (2) months of the end of each <br /> fiscal year which itemizes 1) the expenditure of funds on the Project, 2) progress to date in the <br /> implementation of the Project and any other projects funded by TFCA funds. Sponsor shall <br /> submit the results of the monitoring of the performance of the Project as specified in Section 5 <br /> within 3 months of project completion. <br /> Sponsor shall maintain employee time sheets documenting hourly labor costs incurred in the <br /> implementation of the Project or request approval of an alternative method to document staff <br /> costs charged to the Project. <br /> Sponsor shall, during the term of this agreement and for three (3) years following completion <br /> of the Project, allow BAAQMD staff, its authorized representatives, and its independent <br /> auditors to conduct performance and financial audits of the Project. During audits, the Sponsor <br /> will make available to BAAQMD in a timely manner all records relating to the Sponsor's <br /> expenses and performance of the Project. During inspections, the Sponsor will provide, at the <br /> request of BAAQMD, access to inspect the Project and related records. <br /> Sponsor shall, during the term of this agreement and for five (5) years following completion of <br /> the Project, keep all financial and project implementation records necessary to demonstrate <br /> compliance with this Agreement. Such records shall include documentation that demonstrates <br /> significant progress has been made for projects for which extensions to the completion date are <br /> requested. <br /> Sponsor shall use the Alameda CTC logo a.nd BAAQMD's approved TFCA logo on 1) signs <br /> posted at the site of any construction associated with the Project, 2) any vehicles or equipment <br /> operated or obtained as part of the Project, and 3) any public information material related to <br /> the Project such as websites and printed materials, including transit schedules, brochures, <br /> handbooks, maps and other promotional material. Sponsor shall credit the Alameda CTC and <br /> BAAQMD as a fu.ndi.ng source for the Project in any related articles, news releases or other <br /> publicity materials. Sponsor shal.I demonstrate to the Alameda CTC through evidence such as <br /> photographs of signs and vehicles and copies of print material, press releases and website <br /> postings, that the Alameda CTC's logo and BAAQMD's TFCA logos are used a.nd displayed as <br /> requi.red and that the CMA and BAAQMD have been credited as a funding source. <br /> Sponsor shall, to the extent not otherwise prohibited by law, and to the extent required by the <br /> California Public Records Act (California Government Code section 6250 et seq.), place in the <br /> public domain any software, written document, or other product developed with funds <br /> received through this Agreement. <br /> Sponsor shall return to the Alameda CTC any funds realized from the sale of any vehicle(s) <br /> purchased with TFCA funds, if following the date of purchase of the vehicle(s) such sale occurs <br /> prior to the last day of the last year listed as the project's "Years of Effectiveness" i.n Appendix <br /> A. The amount of funds returned to the Alameda CTC shall be proportional to the percentage <br /> of the TFCA funds originally used to purchase the vehicles. <br />
