Toth, P.E., Unit Chief <br />Brownfields and Environmental Restoration Program <br />700 Heinz Avenue <br />Berkeley, CA 94710 -2721 <br />Dear Ms. Toth, <br />receipt We are in of your COM regarding the initial Stud Negative <br />Declaration for, the,proposed_.project at 2450 Washington_ Avenue, PLN2009- 00.006, in <br />the letter dated October 25, 2011. In that letter, you state that the DTSC reviewed the <br />subject site case file and found that the "Project Site did not appear to pose a threat to <br />human health or the environment. Therefore, DTSC determined that no further action is <br />necessary at this time with respect to investigation and remediation of hazardous <br />substances at the Property." However, a further comment stated: <br />if previously unidentified hazardous substances, sumps, underground tanks, or any <br />other structures are encountered during excavation and grading, the applicant shall <br />inform Department of Toxic Substance Control (DTSC) and they will need to be <br />addressed as part of this project. For example, if hazardous substances were <br />encountered, the project should include: (1) an assessment of air impacts and health <br />impacts associated with the excavation activities, (2) identification of any applicable local <br />standards which may be exceeded by the excavation or demolition activities; including <br />dust levels and noise; (3) transportation impacts from the removal or remedial activities; <br />and (4) risk of public upset should be there an accident at the subject site. <br />As a response, we have added the above language as a recommended condition of <br />approval on the project. The above comment, in its entirety, is included in the <br />recommended Conditions of Approval, item XIV.A. <br />Thank you for your response to the environmental review.
