principal of the Term Bonds upon the mandatory sinking fund redemption <br />thereof. <br />SECTION 4.03. Investment of Moneys in Funds. The Trustee shall invest moneys in the <br />funds and accounts established and held by it hereunder in Permitted Investments specified in <br />the Request of the City (which Request will be deemed to include a certification that the <br />specified investment is a Permitted Investment) delivered to the Trustee at least two Business <br />Days in advance of the making of such investments. In the absence of any direction from the <br />City concerning the investment of amounts held by the Trustee hereunder, the Trustee shall <br />invest any such amounts solely in Permitted Investments described in clause (g) of the <br />definition thereof. The City shall ensure that all Permitted Investments mature not later than the <br />date on which the funds invested therein are required to be expended. <br />Obligations purchased as an investment of moneys in any fund or account will be <br />deemed to be part of such fund or account. Whenever in this Indenture the City is required to <br />transfer any moneys to the Trustee, such transfer may be accomplished by transferring a like <br />amount of Permitted Investments. All interest or gain derived from the investment of amounts <br />in any of the funds or accounts held by the Trustee hereunder will be retained in the respective <br />fund or account from which such investment was made. For purposes of acquiring any <br />investments hereunder, the Trustee may commingle funds held by it hereunder upon receipt by <br />the Trustee of the Request of the City. The Trustee or an affiliate may act as principal or agent <br />in the acquisition or disposition of any investment and may impose its customary charges <br />therefor. The Trustee shall incur no liability for losses arising from any investments made under <br />this Section. <br />The City acknowledges that to the extent regulations of the Comptroller of the Currency <br />or other applicable regulatory entity grant the City the right to receive brokerage confirmations <br />of security transactions as they occur, the City specifically waives receipt of such confirmations <br />to the extent permitted by law. The Trustee will furnish the City periodic transaction statements <br />which include detail for all investment transactions made by the Trustee hereunder. <br />The Trustee or any of its affiliates may act as sponsor, advisor or manager in <br />connection with any investments made by the Trustee hereunder. <br />13 <br />
