2) Where a contractor communicates with customers, clients, and other members of the <br />public by telephone, telecommunication devices for deaf persons (TDD's) or equally <br />effective communication systems shall be used. <br />3) A contractor who receives Federal assistance as part of the CDBG program shall <br />adopt and implement procedures to ensure that interested persons (including <br />persons with impaired vision or hearing) can obtain information concerning the <br />existence and location of accessible services, activities and facilities. <br />4) A contractor is not required to take any action that would result in a fundamental <br />alteration in the nature of a program or activity or in undue financial or administrative <br />burden. <br />16. FINANCIAL MANAGEMENT AND RECORDING SYSTEM. If the Borrower is a government agency, <br />the Borrower shall comply with OMB Circular A -87, "Principles for Determining Costs Applicable to Grants <br />and Contracts with State, Local and Federally- Recognized Indian Tribal Governments," and the sections of <br />24 CFR 85, "Uniform Administrative Requirements for Grants and Cooperative Agreements to State and <br />Local Governments," specified at 24 CFR 570.502(a). If the Borrower is not a government agency, the <br />Borrower shall comply with OMB Circular A -122, "Cost Principles for Non - Profit Organizations" or OMB <br />Circular A -21, "Cost Principles for Educational Institutions," as applicable, and OMB Circular A -110, "Grants <br />and Agreements with Institutions of Higher Education, Hospitals and Other Non - Profit Organizations," as <br />specified at 24 CFR 570.502(b). All Contractors shall comply with the applicable provisions under OMB <br />Circular A -133, "Audits of States, Local Governments, and Non - profit Organizations." <br />If indirect costs are charged the Borrower will develop an indirect cost allocation plan for determining the <br />appropriate Borrower's share of administrative costs and shall submit such plan to the City for approval. <br />17. PROGRAM INCOME. In the event that the Borrower earns any program income, it shall comply <br />with the requirements set forth in 24 CFR Part 570.504, Subpart J. <br />18. OFFICE OF MANAGEMENT AND BUDGET STANDARDS The Borrower shall procure all materials, <br />property, or services in accordance w/ the requirements of 24 CFR 84.40 -48. <br />175-5895.2 42 <br />
