File Number: 12 -028
Center has been added to the Schedule because a default on the lease occurred
after the adoption of the original EOPS. As noted on the current schedule, the
obligation may or may not ultimately be deemed enforceable, pending the results
of negotiation and, potentially, litigation.
The legislation, as written, does not provide complete clarity in terms of defining
Enforceable Obligations. Staff has created the attached amended EOPS with the intent
of being as inclusive as possible while still conforming to the requirements of Section
34169.
Note: The amended EOPS has not been finalized at the time of the writing of this Staff
Report because Agency staff is seeking legal clarification on some related issues. The
final version will be provided to the Agency Board as an attachment to the Resolution as
early as possible in advance of the scheduled meeting.
Previous Actions
The Agency adopted the original EOPS on July 18, 2011.
Fiscal Impacts
None. Although the Enforceable Obligation Payment Schedule outlines the details of
several financial obligations, the Schedule does not have a material impact on any
amounts owed.
PREPARED BY: Jeff Kay, Business Development Analyst, Community Development
City of San Leandro Page 3 Printed on 112012012
