File Number: 12 -028 <br />Center has been added to the Schedule because a default on the lease occurred <br />after the adoption of the original EOPS. As noted on the current schedule, the <br />obligation may or may not ultimately be deemed enforceable, pending the results <br />of negotiation and, potentially, litigation. <br />The legislation, as written, does not provide complete clarity in terms of defining <br />Enforceable Obligations. Staff has created the attached amended EOPS with the intent <br />of being as inclusive as possible while still conforming to the requirements of Section <br />34169. <br />Note: The amended EOPS has not been finalized at the time of the writing of this Staff <br />Report because Agency staff is seeking legal clarification on some related issues. The <br />final version will be provided to the Agency Board as an attachment to the Resolution as <br />early as possible in advance of the scheduled meeting. <br />Previous Actions <br />The Agency adopted the original EOPS on July 18, 2011. <br />Fiscal Impacts <br />None.
